00:01:02I mean, he's repeating the gold medal.
00:01:04And I think this is what's really significant going forward with shaun white.
00:01:08He's pushing the boundaries of this sport.
00:01:10He's only 23 years old.
00:01:12He already said he's coming back for 2014 in russia.
00:01:17So watch out, the rest of the snowboarding world.
00:01:20And then we have another twofer.
00:01:22I was going to say, in the long track, shani davis, did you watch that, tamron?

00:01:29I glanced up when I saw it, and I thought oh, my god, he's going to win again, and it blew me away.

00:01:35I mean, it's so hard in that sport, these kinds of sports, to repeat.

00:01:39He took the gold.
00:01:41Chad hedrick took the bronze.
00:01:42And, again, this was the winningest single day ever for the u.s. in the winter olympics.
00:01:49>> Well, what do we look forward to today, chris?
00:01:52>> Reporter: Two huge things i want to make sure we know, and that's the golden girls of the halfpipe.
00:01:57We have three american women snowboarders, all of whom have a chance to medal here.
00:02:04Hanna teeter is the returning gold medalist.
00:02:08She certainly is going to be one to watch today.
00:02:10The other thing, of course, tonight is the men's figure skating.
00:02:14And we have evan lysacek out there who absolutely skated a flawless short program.
00:02:19But he has to go up against the king of the jumps, plushenko.
00:02:26It is going to be, I think, probably one of the best men's finals we've seen in olympic history, and that's going to be happening tonight.

00:02:33>>> And wednesday, was, as we mentioned, the best day for american athletes when picked up sex medal six medals.
00:02:42That puts team usa back in first.

00:02:48On to the other sports story people are talking about.
00:02:51Tiger woods breaking his silence, but the troubled star is being criticized for what he plans to do tomorrow.
00:02:56Tiger has stayed out of the spotlight ever since the scandal of his affairs when it broke last november.
00:03:03Yesterday after word came that tiger would finally speak, we got this picture of him jogging.
00:03:07It was released.
00:03:08Nbc's kerry sanders is live in st. augustine with the latest.
00:03:12Kerry, we understand that tiger woods is trying to control the environment of -- and we can't call it a news conference, it's just a public statement he's making.
00:03:19>> Reporter: Yes.
00:03:20But it's kind of contrived in what they're going to do.
00:03:24He's going to come into a room.
00:03:25There will be one camera there.
00:03:27He's invited some friends.
00:03:28He's invited three wire service reporters.
00:03:31They're not allowed to ask questions.
00:03:34And there are three other print reporters from the gulf writers association who are yet to be selected who will also be there.
00:03:39I guess one of the big questions is what is he going to say?
00:03:42But another one is his wife, elin nordegren, going to be there.
00:03:46There she is on the front page of the "people" magazine that's just out.
00:03:50" and I guess the real choice is whether she'll be there or not.
00:03:54And the inside sources that we have at nbc news tell us that right now tiger is still pleading with elin to join him at that news conference.
00:04:03But she has not yet agreed to do that.
00:04:06Of course, it would be a very powerful image were she to be standing next to him.
00:04:10Just as much, it will be a very powerful statement if she is not standing next to him when he gives us whatever he is going to say on camera tomorrow.

00:04:21And they're sending the signal out from that camera to every television station in the world.

00:04:31That is when tiger woods is going to make that statement.
00:04:34We're going to have a great panel in place to get perspective on really what this means for tiger woods and the world of golf.
00:04:40>>> Also, former new york city police commissioner bernard kerik is awaiting sentencing right now in a new york courtroom.
00:04:48He pled guilty to eight felonies including obstruction, tax charges and making false statements to the federal government.
00:04:53His nomination by then president bush for homeland security chief was derailed following corruption allegations.
00:05:00He could now face up to 61 years in prison.
00:05:03>>> And also in just a few minutes, president obama will meet with the dalai lama in the map room of the white house residence.
00:05:10It's a long-awaited meeting given that the president chose not to meet with the spiritual leader last october.
00:05:18Now, the move was seen as a diplomatic gesture to china.
00:05:21And it was just one month before president obama's summit with chinese leaders in beijing.
00:05:26So the chinese government said to be not happy about today's meeting.
00:05:32Nbc's mike viqueira is at the white house.
00:05:34A lot of details.
00:05:35It won't be one on one.
00:05:36It's not in the oval office.
00:05:37So the white house, the president aware of perception is reality, especially when dealing with china.
00:05:42>> Reporter: Well, that's right, tamron.
00:05:44You made reference to the fact that president obama met with the chinese premier back in november.
00:05:48And at that meeting, according to white house officials, the president informed the chinese leader that he would be having this meeting with the dalai lama and that it would go forward here in the white house.
00:05:58Now, outside the gates here of the white house, we have about a dozen tibetan flags fluttering inside.
00:06:04In just a matter of a few minutes, we will have that meeting between the president and the spiritual leader of tibet.
00:06:09Of course, china very angry about this meeting.
00:06:11But it is not the first time.
00:06:13Going back to bush 41, george bush, he had a meeting, a similar meeting with the dalai lama.
00:06:20And on through the course of the last 12 or 19 years, we've had several of these meetings, none of which, tamron, take place in the oval office.
00:06:26And that is a concession of sorts to the chinese dealing with appearances.
00:06:31There are any number of issues on the table now between the united states and the chinese government including human rights, including an arms sale to taiwan that the united states has made that the chinese are very upset about.
00:06:41Of course, the trade imbalance and the fact that china now is the largest holder of u.s. debt.
00:06:48And let's not forget about the most recent flare-up dealing with internet freedom and the fact that there were cyber attacks on google -- the google web page within china.
00:06:56So a whole hossues here serving as a backdrop.
00:07:03>> I understand that the dalai lama may speak after this meeting?
00:07:06>> Reporter: Well, that's right.
00:07:07We will not see him speak in a traditional photo-op.
00:07:11Obviously that's not happening in the oval office, but he may come to cameras outside the west wing in the white house driveway which is the place where cameras are always staked out.
00:07:18And we could hear from the dalai lama in person at that time.
00:07:25the economy, new jobless numbers show a surge in newly laid-off workers.
00:07:29The labor department says first-time claims for unemployment benefits rose by 31,000.
00:07:34The gain dampens hopes about how quickly the labor market may improve this year.
00:07:38>>> And president obama is taking on the ballooning deficit today.
00:07:43A short time ago, in fact, the president announced that he is creating a new bipartisan commission to deal with this country's deficit.
00:07:50Former clinton white house chief of staff erskine bowles and alan simpson will co-chair the panel.
00:08:00In an effort to reduce the deficit by 2015, he called for patience.
00:08:04>> American's fiscal problems won't be solved overnight.
00:08:07They've been growing for years.
00:08:08They're going to take time to wind down.
00:08:09But with the commission that I'm establishing today and the other steps we're pursuing, I believe we are finally putting america on the path towards fiscal reform and fiscal responsibility.
00:08:21>> Now, the administration forecasts the deficit will hit a record $1.5 trillion this year.
00:08:26>>> And developing news from outside of houston, texas, take a look at this.
00:08:3022 Train cars off the tracks there.
00:08:33An evacuation initially ordered for a one-mile radius has since been lifted.
00:08:38So far no injuries reported.
00:08:39But officials are investigating exactly what happened in that big train derailment.
00:08:44>>> And now to haiti where two of the ten american missionaries arrested on those child kidnapping charges are still behind bars.
00:08:51But a judge released eight others yesterday.
00:08:53They arrived in miami overnight, and they are expected to head to their homes in idaho and texas as soon as today.
00:09:00So far the eight have declined to answer any questions from reporters.
00:09:04Nbc's ian williams is in PORT-au-PRINCE WITH THE LATEST On the two americans who are still behind bars.
00:09:09What more can you tell us about their status?
00:09:12>> Reporter: Good morning, tamron.
00:09:14Well, those two remaining will appear in court later today.
00:09:18The judge will be questioning them.
00:09:21He wants to know what they were doing on previous visits to haiti.
00:09:24He also wants to try and find out more about their relationship with jorge quelo, the lawyer advising the group.
00:09:35It turns out he's wanted for people smuggling elsewhere.
00:09:38Now, the lawyer to the two remaining missionaries said he expects them to be released within two or three days.
00:09:45Although court sources tell us that's not necessarily the case.
00:09:48It is really entirely up to the judge.
00:09:50Now, that said, my sense is the judge was rather keen to see the eight missionaries yesterday.
00:09:59They have very much overshadowed the humanitarian effort here.
00:10:02They've been a distraction to the government, to the judicial system or what's left of it.
00:10:05They've also been a distraction to the aid effort.
00:10:09And many agencies here going as far as saying it damaged some of their emergency efforts, their efforts to legitimately take people from here.
00:10:19So the speculation is that the court will want to see -- to go through the procedures, but to see those two remaining missionaries sent home.
00:10:28But there are still some questions to be asked, tamron.

00:14:20According to kxan, a small plane has crashed into a building in north texas.
00:14:24The building is the echelon building on mopack and 183.
00:14:31No other details regarding injuries or the situation.
00:14:33Crews are on the way.
00:14:34But according to kxan, a small plane has crashed into the echelon building in austin, texas.
00:14:40We'll bring you more on that as soon as we get it.
00:14:43>>> And tiger woods breaking his silence tomorrow with his first on-camera statement since that sex scandal broke in november.
00:14:48And it's going to be held at the tpc saw grass clubhouse in florida.
00:14:54Only a select few reporters will be allowed.
00:14:57Will also allow friends and a couple colleagues to be there.
00:15:00There will be no questions allowed.
00:15:01Joining me here in studio, correspondent jeff johnson and dave ziron, thank you both for joining me.
00:15:10Dave, let me start off with you on this.
00:15:11You've got a lot of people saying what's the point?
00:15:13Tiger's not going to take any questions.
00:15:15He could have released a statement on paper.
00:15:17Is this the wrong way to go about it?
00:15:18>> Well, yeah.
00:15:19I do think it's the wrong way to go about it because there are really two people on earth right now.
00:15:24There are people who believe that this story really needs to go away.
00:15:29They hate the fact that it ruined their thanksgiving and their christmas.
00:15:32And then there are people who want tiger to actually give a pound of flesh.
00:15:36They want him on tv with oprah.
00:15:38They want the tears in his eyes.
00:15:40They want him begging for forgiveness.
00:15:42And this type of news event, this carefully choreographed event, will satisfy neither of those camps.
00:15:48And it's only going to raise more questions.
00:15:51And specifically it's going to raise the question, when will tiger take questions?
00:15:56>> But jeff, let me ask you, isn't this consistent, though, with what tiger has always been?
00:15:59I mean, not -- certainly his life has changed, but in the past, since he became a celebrity, a golf phenomenon, he has controlled his message.
00:16:08So isn't this simply an extension of really the person he tried to bill all along?
00:16:12>> Well, it is an extension, but he doesn't have the luxury for that right now.
00:16:16What we're seeing is him taking a page out of what not to do in public relations 101.
00:16:21This is not a press conference.
00:16:22It's a public service announcement.
00:16:24And at the end of the day, he really could have just taped it and put it on his website or do something written.
00:16:30I think he does himself a disservice to the fans that he's trying to get back on his side.
00:16:34He does himself a disservice because he doesn't seem as if he's being transparent at this point.
00:16:40And even those people that just want to see him play golf again want him to be able to do that with a clean slate, not with all these questions still in the air.
00:16:47>> Jeff, you know, in this press conference, once he makes this statement, once he apologizes and admits to the affairs which he's already done, what questions really are there to be asked?
00:16:56I try to put myself in a situation where you're a reporter.
00:16:59What are you going to ask him about the porn star?
00:17:01Are you going to ask him, was it 13, tiger, or was it 8?
00:17:04I mean, the bottom line is, you're sorry, and when are you going to get back to playing golf?
00:17:08>> But tamron, the question is why invite the press if you're not allowing questions?
00:17:12So I don't think it's about at this point what would we ask him on the front end.
00:17:16It's about what would we ask him in response to what he says.
00:17:19And because he's not allowing that to happen, he's putting himself in a difficult place.
00:17:24Where if he would have just said, look, I'm going to take a few questions that he could have controlled, you wouldn't have people casting him in this pejorative light before he makes a statement at all.
00:17:35>> Dave, when will he finally get back to playing golf?
00:17:38We know the timing of this statement, when accenture has a big tournament, they dropped him, one of the few big companies, actually, who did drop him.
00:17:46When is he going to play again?
00:17:47>> I think he's going to play sooner rather than later.
00:17:50And I think this because he is speaking opposite the accenture tournament.
00:17:54Keep in mind that yesterday we saw the first pictures of tiger woods since who knows when.
00:17:58I thought he was rooming with jimmy hoffa or something.
00:18:01And in the pictures where he was running, everything on his body had a nike swoosh on it.
00:18:06>> Yeah.
00:18:06>> I mean, he was -- >> he probably doesn't own anything without a nike swoosh.
00:18:10But I want to put up again the graphic of the schedule.

00:18:57We've seen celebrities come back from worse situations and be able to gain back some of theiren dorsmentes.
00:19:03Really this is going to be good for golf.
00:19:04Tiger being at those tournaments is as important for golf as it is for tiger.
00:19:08>> And jeff, on that point as a person who really doesn't watch golf, I appreciate that it is a sport.
00:19:15Really not into it.
00:19:15I guarantee you I'd be in front of the television watching his first tournament.
00:19:19Just to see.
00:19:19You want to see what happens.
00:19:21The atmosphere of it.
00:19:22I'm sure I'm not alone.

00:23:17We're following some breaking news out of austin, texas.
00:23:20This is the first images we're getting in.
00:23:22These are the first images we're getting in of a small plane crash into a building.
00:23:26The building is called the echelon building.
00:23:30This is near highway 183 in north austin.
00:23:34No report -- no confirmation, i should say, on injuries or any fatalities.
00:23:39Getting information on this echelon building, it's a commercial building.
00:23:43It has what I'm being told a number of businesses in it.
00:23:46For example, at least according to the website, a yoga studio, for example, is in there.
00:23:52We're working to get more on the businesses in this echelon building.
00:23:57But a small plane has crashed.
00:23:58You see the thick black smoke there.
00:24:01They are diverting traffic, if i can see this.
00:24:03It looks like they're maybe moving traffic on the side of the highway that is nearest the building.
00:24:10You see a lot of people on the exit ramp leaving there.
00:24:13But traffic is still flowing on both sides here.
00:24:16But this small plane has crashed.
00:24:18We don't have a description of the plane itself.
00:24:20It's crashed into this building.
00:24:21The 9400 block of research boulevard near highway 183 in north austin.
00:24:27If you're in the texas area and austin area, you'll be familiar with this.
00:24:30But we'll get more details on it hopefully and more information on the pilot and any people in that building at the time.
00:24:36>>> Also in today's tech watch, a new virus has reportedly infected 75,000 computers around the world.
00:24:44Now, this virus collects user names and passwords.
00:24:46And then it feeds that information back to hackers.
00:24:49One software security firm says both commercial and government systems have been compromised including online banking sites, hotmail and social networks like facebook.
00:25:01The hackers are based out of eastern europe.
00:25:02>>> And as always, there are some stories out there that made us say no way this morning.
00:25:07Let's start in massachusetts.
00:25:08A 75-year-old woman foiled a robbery by whacking the suspect with a price scanner.
00:25:14Watch her go after him.
00:25:17He's 34 years old.
00:25:18Less than half her age.
00:25:19But obviously, he doesn't have half of her courage or he wouldn't be robbing the 7-eleven.
00:25:24The would-be robber walked in, tried to get into the register.
00:25:27That's when granny went whaling on him.
00:25:29The suspect took off but police did end up arresting that individual.
00:25:34And thank goodness she was not hurt, obviously, because he could have retaliated.
00:25:36>>> And they are taking origami to new heights in japan with a new world record.
00:25:42A giant paper crane built in hiroshima has been recognized as the largest ever.
00:25:47It took three days and 800 people to make it.
00:25:51It has a wingspan of nearly 270 feet.
00:25:54Look at that.
00:25:55It was meant to symbolize a wish for world peace.
00:25:57That's very nice.
00:25:59Japan set the previous record nearly a decade ago.

00:26:17For example, the website for the building indicates that it has a yoga studio, for example, in there.
00:26:25And it's also a real estate business in there.

00:26:36And you see the traffic on both sides.
00:26:39This is highway 183.
00:26:40We're getting a different vantage point now.
00:26:42You can't see the smoke from there, but you see that the traffic is slowing.
00:26:45We're working to get more details on it.

00:26:48But this vantage point really doesn't show us anything at this point.

00:30:13We're getting more details on that small plane crash in austin, texas.
00:30:17Kxan is reporting that two people are unaccounted for.
00:30:20Rescue efforts are under way.
00:30:22It's no word yet if the two people are from the plane or people in the building.
00:30:26As you can imagine, a small plane hits a building, people are going to run out of there.
00:30:31And we're not sure if they're trying to account for folks who were in that building or if this -- if these two people that they're saying are unaccounted for are the pilot and a passenger of that aircraft.
00:30:41Emergency officials are on the scene.
00:30:45It's a seven-story building.
00:30:47One witness describes it, he was working near there, describes it as a huge fireball.
00:30:52And it went right into the building.
00:30:56Again, this is a man who was quoted near -- he was working near highway 183 and says that there was a huge fireball that went right into the building.
00:31:06The fire chief there says that the department has gone into a defensive position, meaning that firefighters have been ordered to retreat from the building because of danger.
00:31:15So we're working to more on this one.
00:31:18But you see that black smoke on the horizon there from the building itself.
00:31:24What we've been able to find in this information, and we hope certainly that it is accurate, is that this building houses a realty company, a scientific investigation, therapy, massage building as well.
00:31:39Perhaps a professional education center.
00:31:41These are some of the businesses listed at that address where we're getting the reports from kxan.
00:31:48A small airplane has crashed into that building.
00:31:50And the fire department is set to be in a defensive position.
00:31:54And that they are retreating from the building because of the danger.
00:31:58So I don't know if they are fearful of an explosion at this point depending, obviously, on what's in that building and what's housed there.
00:32:07The emergency management assistant director says that, quote, we have no idea right now if there arany patients or how many.
00:32:17Referring to whether there are any people in that plane who are injured.
00:32:21We've got this report that there are two people unaccounted for at this time.
00:32:24So we're working to get more details on this.
00:32:27Hopefully we can get someone on the phone.
00:32:29We're working on getting someone on the fire department.
00:32:32Again, just to reset this.
00:32:33So you'll know what we're covering.
00:32:36This is in northwest austin at an office building where a small plane has crashed into a commercial building.
00:32:44The emergency officials say it is a seven-story building.
00:32:46They have no idea right now of injuries.
00:32:49But two people, according to kxan, unaccounted for at this time.
00:32:53A witness there says that he was driving near 183 when he saw a small plane very low flying over the highway.
00:33:02He said he saw it and then banked heavily to the right before heading into the building.
00:33:07And this witness described seeing at that point a huge fireball.
00:33:11This is according to the statesman.
00:33:14That's what you're looking at.
00:33:15The newspaper's website where they are streaming in video, i imagine, from a traffic camera or something affiliated with their newspaper.
00:33:22Usually you have traffic cameras around these areas, especially big highways like 183.
00:33:29They're feeding in their video on their website.
00:33:32I know we're working to get someone on the line from the fire department hopefully to get some more information.

00:34:01What I know is that we have a small private plane that crashed into a building, causing that building to catch on fire.
00:34:07Our initial units did some preliminary rescues.
00:34:10They're in the process of setting up and fighting that fire now.
00:34:16We had reports about ten minutes ago of two people from the building unaccounted for.
00:34:20So they were working on trying to figure out where they would be in the building and trying to find them.
00:34:26So it is an ongoing process right now.
00:34:28I do have a pio and some more units en route.
00:34:32And we can give you some further updates, maybe a little further on this situation.
00:34:37>> Before we let you go, I've got to ask you, there's a report from fire chief rhoda mae kerr that firefighters are in a defensive position, meaning that the firefighters have been ordered to retreat from the building because of danger.
00:34:48What can you tell me about the danger there?
00:34:51Are they expecting an explosion?
00:34:54>> I don't know that it's so much an explosion but probably some instability in the building.
00:34:58If you've got a quote already from chief kerr, she is actually on scene and much better to answer any calls or questions that you might have from there.
00:35:06>> Right.
00:35:06This is what the statesman, the paper, there is reporting.
00:35:10But let me ask you because we're looking at what I believe is a traffic camera of the scene there.
00:35:15You've got traffic still flowing on both sides.
00:35:17Any word on if they're going to block off -- that's highway 183, right?
00:35:23>> Probably not the main highway.
00:35:25We may block off some of the frontage roads and some of the other roads around this building.
00:35:29We try not to shut down those main arteries of traffic because that causes almost more problems than it fixes.
00:35:33>> Well, it looks like the black smoke is sailing across 183.
00:35:39I imagine it makes it tough to drive through.
00:35:41That if this picture is giving an accurate detailing of the visibility, one side of 183, you can barely see if u're driving.
00:35:50>> In that case, you know, there would be a call on whether they feel it's too unsafe for the drivers to actually drive through there.
00:36:00>> Authorities report it's the echelon building, seven stories.
00:36:03Do you know any more about the building?
00:36:04>> No, ma'am, we don't have all of that information.
00:36:06We're very preliminary into this.
00:36:08Like I said, I've got a pio that is on scene that will be doing some further updates as we go along in this incident.

00:36:32>> What I heard from my employees in the building was that there was an explosion and that they have been told that there had been a plane crash.
00:36:40Again, that is thirdhand.
00:36:42So I don't know that that is, in fact, correct.
00:36:43>> And your building is next door.
00:36:45Do you know anything about the building that the small plane hit?
00:36:50>> Well, I understand that there are some -- obviously, there are other officers in there including -- I've been told there's an irs office in that building, but I don't know that that is correct.
00:37:01>> How close are you right now to where this is all happening?
00:37:04>> Caller: I couldn't get that close.
00:37:06Right now I'm about half a mile away.
00:37:08I was able to drive by on 183, as you were just talking about.
00:37:12You can see significant holes in the side of the building, and there's flames coming through the windows.

00:37:19>> Caller: Not from the angle that I am at, but I'm not at the same angle I was at before.
00:37:24>> But when you were driving near there, you actually saw -- and how long ago was that, ben?

00:37:41And it's hard to tell if any of these buildings are really tall there.

00:41:24We're getting new images in of this small plane crash to a building in austin.
00:41:28According to the reports from kxan there, the collision shook the entire building and the entire front of the structure is gone and on fire.
00:41:37That is according to some information they are receiving from witnesses.
00:41:41And there are four separate fires reportedly burning in the building.
00:41:45Some 50 to 100 people are said to be outside and watching this.
00:41:49Let's listen into the local affiliate there.

00:42:01As you can imagine, just a crazy scene.
00:42:03And he's continuing to gather information for us.

00:42:17This is a very chaotic scene right here at mopac and 183.
00:42:21Take a look at this building back here.
00:42:23This is what we understand to be the echelon building.
00:42:25And there has been a plane that has crashed into this building here earlier this morning.
00:42:32This is at the corner of mopack and 183.
00:42:36If you're familiar with this area, this is n dave & buster's, marie callendar's, some different businesses near the arboretum area near grace church up here.
00:42:48And we understand there are lots of offices and different people inside this building this morning.
00:42:55It doesn't look to be a good scene inside.
00:43:00We don't know if there were survivors or not inside this building.
00:43:04We've seen some ems folks out here this morning.
00:43:07But you've got to believe there were some people who were at least injured or hurt, maybe even killed in this scene this morning here at the corner of mopack and 183.
00:43:16We understand it was a small plane, a cherokee.
00:43:18There was a pilot here this morning who witnessed the scene.
00:43:22And we're trying to get some more information from him about what he actually saw.
00:43:27He said he believed the plane actually almost hit him.
00:43:30This is pretty amazing.
00:43:31We believe that we can see where that plane actually hit.
00:43:35Mark, if you can see the brown dirt right there, that's maybe where the plane actually hit right into that building.
00:43:41That looks to be the biggest point of impact right there.
00:43:47And some amazing pictures, really, this morning.
00:43:50We saw this entire building on fire.
00:43:52Obviously, nothing I have ever seen here in austin, texas, before.
00:43:57>> Reporter: Our matt fleener live on the scene there.
00:43:59And you can see that brown dirt, that's where that retaining wall is.
00:44:04>> Reporter: Unfortunately, chris or whoever is back in the studio right now, I can't hear you, unfortunately, but we do see lots of firefighters out here.
00:44:12The highways are still open.
00:44:13Now, we can see people coming off of the entrance ramp from 183.
00:44:19They're going north on 183.
00:44:21Traffic south on 183 is still open.
00:44:23Obviously, this would be a huge mess up here if they close these highways.
00:44:27The highways are still open.
00:44:29But, wow, what a scene up here.
00:44:31Really lots of law enforcement personnel.
00:44:34We've probably seen in the upwards of 80 to 90 law enforcement personnel up here today.
00:44:39We see lots of people standing around, milling around, as well, trying to figure out what exactly happened.
00:44:46Presumably these were people -- mark, you can see some of these people that are here.
00:44:50If you take a picture all the way over there across the highway, you can still see people that are outside.
00:44:56They've marked the area off with yellow tape.
00:45:00You can see people, obviously, looking around, trying to figure out what exactly happened here early this morning.
00:45:07We don't know the exact time of what happened this morning.
00:45:09We're supposed to get some more information hopefully here within the next hour or two from the austin police department.
00:45:15I'm looking around, once again, just going to do a real quick survey of the scene.
00:45:20I see an atf agent over there, there's the austin police department.
00:45:24We see lots of other people as well.
00:45:29>> Okay.
00:45:30That's the spot we want to look at right there because that appears to be point of impact.
00:45:33And that appears to be plane re remnants.
00:45:39>> Could be air conditioning.
00:45:39>> I'm not an aviation expert by any stretch of the imagination.
00:45:43That brown dirt there, as you're looking live at it, from what we're telling now, appears that it could be the point of impact.
00:45:51Our carlos was also on the scene and joins us now with another perspective.

00:45:56>> Reporter: Yeah, chris, I'm actually here at 183 and 360.
00:46:02There is a complete wall here.
00:46:03And the freeway here is -- the roads are going very, very slow.
00:46:06Traffic is moving very slow.
00:46:08You can see thick black smoke billowing from the building.
00:46:12The williamson county constable's office has shut down part of 360 here where it meets with 183.
00:46:18I talked to some folks who work over at the bank of america which is a good half mile on the other side of the freeway.
00:46:2500 they felt a huge blast.
00:46:29They went outside and saw smoke billowing from the building.
00:46:33They say that their building shook.
00:46:35We're also hearing that they have -- on the scene they are doing a roll call and trying to make sure that everyone is accounted for.
00:46:44But right here at 183 and 360, there's just, I would say, dozens of law enforcement officials out here.
00:46:50We also keep hearing fire trucks which are rushing over to the scene, trying to make their way through traffic.
00:46:57So very tense situation here right now.
00:47:00>> All right.
00:47:03Again, carla castano on the scene.
00:47:05That could be the shot so far that tells the biggest story.
00:47:07That's the front of -- and just to recap, this is just happening as we're continuing the day.
00:47:13So it is continuing to come in, the information.
00:47:17A small airplane has crashed into the echelon building.
00:47:20And again, that's 9430 research boulevard, building one.
00:47:24And from some of the witnesses that we have had joining us today, that retaining wall that goes in front of that building appears to be completely demolished.
00:47:33And the focus of a lot of emergency operations right now, as you can imagine, you are going to see just about every kind of emergency personnel in central texas on the scene of that as well as probably the federal government.
00:47:46Let's go back to our matt fleener who is there live now.
00:47:49And matt, is that -- first of all, can you hear me?
00:47:52And second of all, is that point of dirt that you were showing us, does that appear from your perspective to be an impact point?
00:48:01>> Reporter: Chris, I had a little trouble hearing you, but I heard something about impact.
00:48:06We believe -- I want to show you where we believe this impact happened.
00:48:11Right back here straight ahead, mark, if you can show it, you can see it looks like it went in on the bottom floor of this building right here.
00:48:19And getting my bearings straight here, that would be coming from the north to the south, almost duesouth, almost due south-southwest into this building right here, across 183.
00:48:35So this had to be flying, just feet above cars here on 183.
00:48:41An amazing sight.
00:48:42And you can see that fire has raced all the way to the top of the building.
00:48:47We're still unclear of any injuries at this point.
00:48:50We have yet t briefed by the austin police department.
00:48:54Obviously, everybody's trying to figure out where everybody else is at this morning, but we've seen two ladder trucks for the austin fire department dousing this building with hoses and some material that would put out the fire.
00:49:07The smoke is still going from this building, as you can see.
00:49:10You can see lots of water that's coming down.
00:49:12We've seen parts of the building just falling, collapsing this morning.
00:49:16It's been amazing to actually watch this building fall and crumble apart.
00:49:20You can see the retaining wall has completely been demolished.
00:49:24We believe -- I don't know, mark, if you can zoom in a little bit, even closer, I'm trying to figure out what that part of a possible plane is.
00:49:32We saw -- or we heard a witness this morning who said he saw the plane just come right over him.
00:49:38He was a former pilot and he believed this to be a cherokee 140.
00:49:42Now, that is not confirmed whatsoever.
00:49:44But he was a former pilot, a former flight instructor.
00:49:47He said that it looked like a cherokee 140 plane that was inside this building.
00:49:52Chris?
00:49:54>> And matt, have you heard anything about the search for survivors inside that building or anything like that?
00:50:01>> Reporter: Well, I'll tell you what, kate, we're across the highway from exactly where this building is at.
00:50:05I can tell you, it's been kind of eerie, because I don't see anyone going into the building itself.
00:50:13There may being firefighters on the other side of this building or ems personnel, trying to get people out, but it looks like -- it looks like nobody is going into the building, at least from this side of the building.
00:50:25We do see one ems uck over there, but we're unsure if there's more ems vehicles on the other side of the building across from us.

00:50:48One of the viewers that called actually works in that building.
00:50:53He's home today because his child was sick.
00:50:55>> Again, we're watching breaking news out of north austin where a small plane has crashed into a build in austin, texas.
00:51:01Let's go to nbc's tom costello, aviation reporter, transportation reporter for us here.
00:51:07Tom, we heard one witness say that he believes it's a cherokee 140 small airplane.
00:51:10That's what the reporter on the scene was told by a witness.
00:51:13Tell me a little bit more about that aircraft, if that is, in fact, the one involved.
00:51:17>> Well, the piper cherokee is really a family of planes.
00:51:21It dates back to the early 1960 and there are a variety of models of them, but they seat generally about six passengers.
00:51:27It's a single engine piston-powered propeller plane.
00:51:31Very reliable and used throughout the country by small aviation enthusiasts.
00:51:36In other words, private pilots.
00:51:37What I noticed here, and I think it's important to notice, the fire damage to the front of that building, I think, is extensive.
00:51:42Which leads me to one of two thoughts.
00:51:45Number one, either the plane was completely loaded with fuel, because perhaps it had just taken off from a nearby airport, or number two, that it may not be a cherokee.
00:51:55I only say that because a cherokee's a very small plane and I am candidly surprised at the extent of fire damage on the side of this building.
00:52:05Nonetheless, we would tell you that, of course, the piper and the -- the piper cherokee is well known to aviation enthusiasts across the country as a reliable single engine private plane.
00:52:16You can see it at virtually every airport in the country right now and the extent of damage here is quite remarkable.
00:52:22>> And tom, to your point about whether this point was full of fuel, the nearest airport is austin berkstram international airport.
00:52:31That's about 15 miles away there there.
00:52:37>> I don't know the plane was departing or if it was arriving, but if it was departing loaded with fuel, that would be one explanation.
00:52:44Also take note of the large number of law enforcement personnel on the scene.
00:52:48That one eyewitness that we had on the phone said that he thought there was a government office inside that building.
00:52:54Perhaps the irs.
00:52:55We can tell you that that is certainly going to be an immediate focus.
00:52:59Was this intentional or was it an accident.
00:53:03And if it was intentional -- >> the irs, the cia, and the fbi all have offices in that building, and that's coming from officials there.
00:53:09>> Well, then, clearly you've got to wonder whether there was some sort of criminal intent here when you have that degree of damage to a build with a private plane.
00:53:20And I think that, clearly, the police and the federal investigators are going to be looking into that.
00:53:24>> Tom, thank you very much.
00:53:27Let me bring in greg fie, former ntsb investigator.
00:53:35Greg, the damage to the front of this building, extensive.
00:53:39A huge hole.
00:53:40What do you see here that struck you already?
00:53:43>> Well, in looking at the damage to the building, and there is one shot of the remnants of the airplane, it does look like maybe a horizontal stabilizer of the airplane.
00:53:56So if it is this single-engine airplane and it was full of fuel, you're going to have around probably 40 gallons of aviation fuel, that if the airport hit the building and spread that fuel over a large area, depending on the construction of that building, there's a probability that you could create a widespread fire.
00:54:18But, again, we don't know what was in the airplane.
00:54:20There could have been some additional incendiary device, if this was an intentional act, that could have proliferated the fire, itself.
00:54:29>> According to the report from kxan, there were four separate fires burning in that building itself.
00:54:35I'm not sure if you heard some of the witnesses say that the plane was flying solo.
00:54:41One man even said it was solo.
00:54:42He said he thought it was going to hit him as it flew into the side of thissing building.
00:54:48>> Well, again, you know, looking at the weather today, you have to look at it from an investigative standpoint.
00:54:55If there was a mechanical problem with the airplane, that the pilot was trying to find an emergency landing area, the last thing a pilot wants to do is hit anything, especially a building.
00:55:07He would look for, or she would look for the highway or some clear area to put the airplane down.
00:55:13So for the airplane to have hit this building, one of the things that the investigators are going to start with is looking at radar data, if it's available, and trying to determine if this was an intentional act or not.
00:55:26>> Does it tell you anything, reports are that the entire building shook.
00:55:29And you said there, as a result of the impact, the entire front of the structure, beyond the smoke we can see, according to reports, is gone.
00:55:39>> Well, the airplane, if it is a cherokee 140 or something of that size, a single-engine piper -- we're not even sure if it's that -- but if it's a single-engine airplane, the fact that you've got a 2,000-pound airplane that strikes this building, you'll get some residual vibration throughout the structure.
00:56:01The key here was, was there some other incendiary or explosive-type device, if this was an intentional act, to do harm to the people or this building, could there vfb something else that created a secondary explosion, which contributed to these multiple fires and the vibration that was felt throughout the entire building.
00:56:19>> How soon would we able to get information on the flight plan, you know, who owned the aircraft.
00:56:25The nearest airport is austin berkstrum international airport and that's about 15 miles away.
00:56:31As they try to deal with the situation, account for people, get folks out of there who may still be in that building, how soon would they have the basic information, the nature of the flight plan of this aircraft?
00:56:44>> I'm sure that inquiry has already been made to the airports, to determine if that airplane originated from austin or even flew through or around that air space.
00:56:53The key here is getting the identification number for the airplane.
00:56:57That will then allow investigators to find out who the registered owner was.
00:57:01Now, the registered owner doesn't necessarily mean that they are the pilot of that airplane.
00:57:07So, you know, you could have a stolen airplane situation here, so there's still a lot of investigative work, but I'm sure that the initial inquiries to the airport is to determine if the airplane was based in austin and if anybody had contact with this pilot or pilots, depending on how many people are in this airplane.
00:57:25I'm sure that that inquiry has already taken place at the airport.

00:00:16We know she was in the home when he set that on fire.
00:00:18He talks about her unreported income.
00:00:20Neighbors were able to help his wife cheryl and their daughter safely get out of that home.
00:00:26Joseph stack was gone at that time presumably headed to the airport in goernltown, texas, to get his airplane that was housed there.
00:00:36Pete, back to what we were discussing.
00:00:38In this note he goes on to say he reached out to everyone.
00:00:40He says, I spent $5,000 of my pocket change and at least 1,000 hours of my time mailing to any senator, congressman, governor who would listen.
00:00:51Would the irs likely have a record of someone who was constantly, I guess, beating them down, angry about his or her situation?
00:01:00>> Well, they would.
00:01:02Of course they would.
00:01:03And it looks like he was involved in some litigation with the irs as well.
00:01:09We should probably say here, tamron, it isn't specifically aimed just -- this diatribe on the web isn't aimed just at the irs.
00:01:18It's a general sort of beef against the government in general, against the bailout for big corporate companies, against the health care plan, the failure, lack of a health care plan.
00:01:28But he then goes on to recite a long history of problems with the tax law and with the irs.
00:01:37>> He has specific details of tax codes he felt he fell under, mentions a tax accountant.
00:01:44Brings us back to the fact the irs was housed in that building.
00:01:47If he has -- the wording here -- reached out to everyone and was complaining, I believe we could say he knew the irs was in that building.

00:02:54So this was a very short period of time under which you can see the plane -- house fire was called in and 30 minutes later or so the plane was down.
00:03:05Whatever happened it was very deliberate, very quick.
00:03:08We can also tell you, as you would expect, the ntsb will investigate the plane crash and they will be joined by local authorities and the fbi if there's reason to believe a government office, the irs, was targeted in this crash.
00:03:22We can also tell you joseph stack did, indeed, own a piper cherokee aircraft we've been recording.
00:03:28It was registered to his business address in california.
00:03:31The address for which his software business was also registered.
00:03:35It was a piper cherokee, single engine plane.
00:03:39It can seat anywhere from six passengers, carry somewhere in the neighborhood of 40 gallons of fuel or so.
00:03:48What many came concerned about early on and witnesses are concerned about, when they said this plane seemed to deliberately come down at a very steep angle of attack and seemed to be being flown well, if you will, a deliberate angle of attack towards that plane.
00:04:07It was blue sky day.
00:04:08They were immediately concerned about the fact this may not have been an accident.
00:04:11Clearly that's the question now.
00:04:14Was this an accident, terrific coincidence or a deliberate attack on a building that contains the irs offices.
00:04:21>> The austin fire department says two people have been injured.
00:04:24One we know was severely burned and sent to the burn center in san antonio from the hospital in austin.
00:04:31Another is there in the hospital in austin.
00:04:33There's also one office worker unaccounted for.
00:04:35This is a person who was scheduled to be at work today.
00:04:39They don't know where this person is.
00:04:41So they are working to try and confirm where this particular office worker is.
00:04:47The faa suppose person says this pilot, joseph stack, did not file a flightplan.
00:04:53But in this case, tom, that would be normal, if you were going to take a small plane trip, right in it's not out of the ordinary for a flight plane not to be filed.

00:05:07Let's underscore this, if his intentions were benign, if he were going to fly below 1,000 feet he would not file a flightplan, unless he goes into a metro area, terminal area around the airport.
00:05:22Clearly austin airport is big enough you should be filing a flightplan if you're flying anywhere near the airport or austin.

00:06:06One was a burn patient, as you've reported.
00:06:10He was transferred to the brooke army medical center in san antonio after being stabilized here with burns that comprised about 20% body surface area, none of which were expected to be life threatening.
00:06:23The other victim suffered smoke inhalation and is currently receiving treatment for that at university medical center at breckenridge and is in stable condition.

00:06:38>> So far you've not heard of other jures, even minor ones in your facility?

00:06:46In fact, we've called around to all the hospitals in the area and no one has had any traffic and no ems traffic related to this incident.

00:14:56What will they do in their inin light of all the information coming in on joseph stack, including the manifesto he wrote at the government, irs, just about anyone.
00:15:07He was angry within the >> the ntsb will work in concert with the fbi, given the fact this could be a criminal event, the fbi is going to want to preserve the evidence as much as possible.
00:15:21Ntsb by its nature investigates incidents and accidents.
00:15:25Yet this was an intentional act.
00:15:27In this classification, they could see this as a suicide.
00:15:30They want to work in concert with the fbi to preserve evidence.
00:15:34If there's any other criminal investigation that's yet to be done and any kind of ramifications from that investigation that the fbi needs the evidence, they will have to preserve it.
00:15:46They will work closely with the board on the investigation.
00:15:50>> Even if indications are this was not an accident, they would still play a role in the investigation as we still learn more?
00:15:57>> Absolutely.
00:15:58The investigation -- typically the board will do the investigation.
00:16:01It was an intentional act.
00:16:04There have been times where the board over the investigative process to the fbi.
00:16:08Usually that's with a commercial airliner.
00:16:11In this case they are going to work hand in hand.
00:16:13Several years ago we had a situation with a 15-year-old boy who stole an airplane and flew it into the side of a building in tampa.
00:16:19>> I remember that.
00:16:22>> It was one of those things they have to work together to preserve that evidence if there's any kind of criminal charges that will come out of this investigation.
00:16:30>> You know, again, looking at this building, you've been with us and watching this coverage 00 local 00 eastern time, the damage is incredible, greg, when you think about it, we talked to the hospital there.
00:16:44Two people were treated.
00:16:46One could be leaving the hospital here in an hour with no jures.
00:16:52Another person burned and not life threatening.
00:16:55>> That's very fortunate for those people.
00:16:57This is a small airplane weighs about 2,000 pounds, carries about 40 gallons of gas, if the tanks were full.
00:17:05If the pilot flew into the side of the buildicoming out of a dive.
00:17:14The structure will take the brunt of that.
00:17:17The atomization, the fuel will cover a larger area.
00:17:22Even though the fire may not be intense, any materials in the building will catch fire and support combustion and spread the fire.
00:17:30The big key here is we do not know in addition to the fuel on the airplane, what this pilot may have done to carry an additional kind of explosive and/or additional fuel.
00:17:41He apparently burned down his own house setting a fire that was a pretty large sized explosion.
00:17:48He may have done something with the airplane to contribute to the enormity of the fire damage.
00:17:54We just don't know at this point.

00:18:22>> The president had a slate of activities at the white house this morning.
00:18:26He did take a motorcade from the white house out to andrews air force base.
00:18:32Overnight out west denver swing, denver, colorado, out west in henderson, nevada, where he's got political events as well as town hall events.
00:18:39What we learned sometime during that motorcade, perhaps when theta to andrews, press secretary robert gibbs did inform the press pool the president himself was briefed at 35 washington time this afternoon by his homeland security adviser who told the president -- gibbs told us, this does not appear to be an act of terrorism.
00:19:04That's all we know at this point.
00:19:06It's possible or likely he'll be provided more information aboard air force one.
00:19:12We won't have a read on that until wheels are down in a few hours.

00:23:04What are you learning about joseph stack in terms of being the primary suspect, a pilot and crashing his plane.
00:23:11>> Let's look at the flight path.
00:23:13This is very telling.
00:23:14We should have it coming up here.
00:23:16This shows he left the georgetown municipal airport.
00:23:19Look at that.
00:23:20It is a direct, straight line hugging the highway right into the echelon building.
00:23:27No deviation or attempt to avoid the building, circle around.
00:23:32Clearly the ntsb and fbi will be looking at this flight path and whether it gives us some indication this was a deliberate attempt to flew right into the irs offices at the building what we can also tell you as we've been reporting throughout the day, joseph stack does, indeed, own a piper cherokee, a fixed single engine plane.
00:23:57It matches the address for his software business in california.
00:24:00Therefore, you can deduce this is a man who was experienced in at least flying piper cherokee planes.
00:24:07As we've also been reporting throughout the day is a widely flown plane.
00:24:13It isn't a terribly difficult plane to fly.
00:24:16Seen at virtually every airport in the country.
00:24:19Former ntsb investigator pointed out it carries about 40 gallons of fuel.
00:24:25Clearly, the many questions they will be asking as they sift through this debris, as they do their tests, metallurgy tests, was there an additional accelerant on board.
00:24:36We have no answer for that the time line, we are aware the first call to the fire department on the house fire 18 and the first call for a plane down came in at 9:55.
00:24:47We're talking about, what, a 20, 30-minute gap there.
00:24:51Clearly you can see the flight path appears to be a very deliberate path as well.

00:29:46They say based on their analysis of the computer coding, it looks like he made the last revision to this website this morning, sometime this morning, february 18th, MAYBE AT ABOUT 6:40 A.M.
00:30:04This appears to be another piece to the time line of his apparent preparation, what law enforcement believes, without being able to prove at this point, that he set this series of events in motion this morning with the intention of flying his airplane into the commercial building there ennear austin that had the irs located in it.
00:30:24This is just another piece of that has he was manipulating, fiddling with, making the final preparations to have this message pop up on his website just this morning.
00:30:35>> Sadly, this is not the first time we've seen, pete, people go online and write these manifestos or have these writing to make it clear to the rest of us wondering why they want it to be quite clear why they are acting in this way and in this case.
00:30:52I've got to ask you, we're getting in e-mails from people here.
00:30:57There's curiosity factor on many levels here.
00:31:01You've got people who wonder why this is considered a domestic issue if this man, in fact, targeted the irs.
00:31:09Why isn't this considered an act of terrorism.
00:31:13That's a question that comes into us so I'll ask you.

00:31:18I guess you could say in one sense it's a good question, you think about bare bones, what appears to happen here is someone attacking a building that contains the federal government, that's precisely WHAT timothy McVeigh did in oklahoma city.
00:31:32The reason is since 9/11, the concept of terrorism has changed some to think that it has less of a kind of one person going in and shooting up the post office kind of thing and more of an al qaeda, government-driven, idea logically-driven thing.
00:31:53There doesn't appear to be that.
00:31:54There's no element here of an act to try to get the government to do something or express an ideological point of view.
00:32:04I guess their initial sense is this is somebody who had a beef with a government agency and wanted to take it out on them as OPPOSED to McVeigh who really had no objection himself to the atf or fbi or any other agencies located in the murrah building in oklahoma city.
00:32:24Granted, it's a somewhat fine distinction.
00:32:27I think part of what's going on here with the federal government is to say, look, this isn't christmas day all over again.
00:32:34This isn't al qaeda -- the terrorists as we've come to think of it.
00:32:37This is completely distinct from that.
00:32:39This really is a crime.
00:32:40>> Pete, you know, we've talked a lot lately about this anger we see directed at the government.
00:32:47It's always obviously been a part of our right to protest and get angry about things.
00:32:53Do they monitor, the federal investigators, are they monitoring this kind of anger more as we see sparks of it around the country?

00:33:03I don't want to direct it at one group, one party or anything like that.
00:33:07We know and you know there's been a lot of talk lately especially after the government bailout of some of those companies.
00:33:14There's a frustration.
00:33:15Do they monitor angry letters or outcries more now?

00:33:30There are people who have criminal pasts who are monitored.
00:33:34But the federal government simply, even if it wanted to, doesn't have the manpower, resources to monitor everybody who is upset at the federal government.

00:34:31His back was to the window when the small plane crashed through there.

00:34:40She survived that house fire authorities say he deliberately set with her and their child inside.

00:35:01This was joseph stack's house.
00:35:04Apparently a domestic disturbance.
00:35:07Joseph stack fled to the municipal air force, about 20 minutes from his house, got into his piper cherokee and flew it basically straight toward this building, this office building in austin, texas, a seven-story building where the workday was under way.
00:35:23It's rather amazing so far you have one person unaccounted for and two injuries considering there were people in the building, it was an impact on the building near a busy highway in austin, texas.
00:35:42Gret feith joins me.
00:35:46An faa spokesman said there was so much damage to the wreckage of the plane, it was hard to identify.
00:35:52How do ntsb investigators go in and attribute to this investigation of how this crash went down.
00:36:02>> One of the first things they will do is examine the accident site itself, look at the wreckage.
00:36:10There are some signs on the airplane, a data plate.
00:36:13They can confirm the aircraft serial number, run it against records.
00:36:17They will look at the airplane to see how it impacted.
00:36:20It's very obvious it hit this building at a very high rate of speed.
00:36:25At least that's what it appears to be.
00:36:26They will pull the wreckage out.
00:36:28There's not a lot of reconstruction to the aircraft that's necessary.
00:36:32It's he evident that this was an intentional act.
00:36:34So unlike an accident where you're trying to determine if there's a mechanical malfunction or failure of the airplane, while the ntsb investigators will look for those kinds of signs, it's evident from all of the other evidence coming in or at least coming in, it's probably an intentional act, not a mechanical accident, in fact driven by the pilot itself flying that into the side of the building.
00:37:04>> If investigators categorize this as they will do, the ntsb will be contributing but not the lead agency here.
00:37:16>> Typically in the criminal event the board takes a back seat.
00:37:19They will help the fbi and support.
00:37:22They will do all the reconstruction necessary.
00:37:23They will gather that type of evidence attributed to the aircraft, because the fbi, while they may have some level of knowledge about aviation, that's one of the board's expertise.
00:37:35They will use that information, assist the fbi in collecting that evidence, preserving that evidence, if there are to be other kinds of criminal investigations that are born out of this particular investigation.
00:37:47>> Greg, I know there's still some question about whether joseph stack may have loaded additional fuel on board his plane or an incendiary device.
00:37:56Will the ntsb be pivotal in determining that?
00:38:01>> I think the ntsb will be contributory.
00:38:05The fbi may have bomb experts that come in.

00:38:28Given the fact, the nature of this fire, how big it was, especially in an office building like this, if the airplane had only 40 plus gallons of fuel, which an airplane of this size typically would have, that's a pretty large fire.
00:38:40So they are going to be looking for evidence of additional incendiary or explosive-type devices that may have contributed to the enormity of this fire.

00:42:24A small plane crash in a building in austin.
00:42:27It's becoming clear, what we're receiving from federal investigators this was deliberate.
00:42:32Let's bring in jim tillman, aviation expert.
00:42:34Jim, we've gotten a lot of information obviously now about this pilot.
00:42:41What do you believe should happen now or will happen now in this investigation?
00:42:45>> Well, the investigation is going to be pretty intense at this point.
00:42:50They are nailing down some facts that will give them strong leads about what may have been motive, if you can call it that, for what happened.
00:42:59I think that it's nice and comforting to know we don't have to without about this being a terrorist act.
00:43:05It was, in fact, a crime if you ask me and something followed by the fbi.
00:43:18>> Again, since this plane belonged to individual, authorities are looking at joe stack, there's not anything to investigate at the airport where he started his flight, george town airport, other than finding out his state of mind at the time with someone there.
00:43:37>> That's one of the points i want to each size.
00:43:41Aviation is not the bad guy this is not the time to determine we should restrict this or that on aviation.
00:43:52This is an individual that did on his own what he did.
00:43:56It would have been more disastrous if he had driven a tanker truck into the building.
00:44:02He happened to use an airplane because that's what he knew how to use.
00:44:08It's important to realize general aviation is not the bad guy.

00:44:13We had another aviation expert on as well wanting to emphasize that you can't just lock down the airports there and not allow people to have access.

00:44:38At this point we have no word on what ntsb is seeing on the ground but we do know what people saw in austin.
00:44:49>> Reporter: Talking to eyewitnesses who saw the crash unfold, one of them is an experienced pilot.
00:45:04>> I heard a light plane.
00:45:05I know the sound well.
00:45:07I've been flying little planes since high school.
00:45:10It was really low.
00:45:11He brushed across parking lot lights, those big 30 foot lights, shot right across that.
00:45:16It was a blue and white fixed gear single engine cherokee 140, one of the safest planes around.
00:45:25Shot right across the road, was going really fast.
00:45:29Those aren't fast airplanes.
00:45:31They cruise about 115.
00:45:34The engine was on full blast.
00:45:36Of course I can't testify to that, but it sure was hauling.
00:45:39>> Oh, man.
00:45:40>> It was a really speedy dive.
00:45:43It what happened right in between the first and second floor of echelon three.
00:45:48>> Can you show our viewers exactly where you believe the plane hit?

00:50:42We're watching local affiliate, talking about the manifesto registered online to a website registered to him right before the plane crash.
00:50:54I've been hearing from some of our viewers that you can no longer see this manifesto online.
00:50:59Basically it starts out, if you are reading this, you're no doubt asking yourself why did this have to happen.
00:51:06Then joseph stack goes on to outline his problems with the government, with the irs, with the bailout, for example of that's one of the things he lists here.
00:51:18Just a smidgeon of it, patriotism cost me $40,000, 10 years of my life and set back my retirement plans to zero.
00:51:27He talks about unreported income his wife made and just a list of other problems or beefs, as pete williams worded it with the government.
00:51:38He signs it joe stack, 1956, 2010.
00:51:43HE DATES IT FEBRUARY 18th, 2010 And refers to the government taking a pound of his flesh.
00:51:51This is the manifesto.
00:51:54Answers, what I believe joe stack wanted, it answers the questions many of us have now and had when we learned this and to be a deliberate and intentional plane crash.

00:52:24Apparently they went to a neighbor's house and they are safe.
00:52:27Again, they have lost a loved one.

00:52:38We were talking about this and looking for details, appears they are investigating this as a crime, a person disgruntled with the irs and took specific steps to show how frustrated he really was.

00:52:55>> One thing our investigating the crime, obviously the investigation shifts away, they will check to be sure, shifts away from the classic aviation investigations.
00:53:07They won't be looking for a problem with the plane or in the maintenance or anything of that sort.
00:53:13Instead this will be a weapon -- the plane will be a weapon he used to carry out a suicide vendetta against the airplane.
00:53:21So the ntsb will have little to do -- they won't be looking for clues as to why the plane crashed.
00:53:28Instead, it will be an fbi-led investigation.

00:57:44We're learning more by the minute about the man joseph stack who flew into the building after he allegedly set his home on fire.

00:57:57We continue to follow what has been a very memorable day for a lot of people in austin, texas.
00:58:03Just over four hours ago witnesses saw a small aircraft flying fast and low over the highway pt the plane then crashed into an office building containing several offices including a regional branch of the internal revenue service.
00:58:17Police believe the pilot was joseph stack, a software engineer with an alleged history of audits, penalties paid to the irs and a simmering rage over experiences with the tax system in general.

00:00:00They would essentially funnel that information to the fbi so they could make a determination, yes, this guy was acting alone, he didn't get help, that sort of thing.
00:00:08>> Also if that was asked for, to find out if the engine was operating, if all the parts were there, that sort of thing.
00:00:19>> We've seen the picture of this crash.
00:00:23How much fuel can they carry and >> depending on the model 40 to 50 gallons, anywhere from 115 to 120 miles an hour.
00:00:32>> The equivalent as if somebody were driving an suv over 100 miles an hour with a full tank of gas and slammed into a building that way?
00:00:41>> Exactly.
00:00:42Only at this point it's going into the side of the building at a higher story level than where a car might go in at the street level or garage level.
00:00:50>> And as far as the fuel, obviously that would be the accelerant.

00:02:26>> As stunning as this manifesto is, it's been stunning to hear what witnesses saw.
00:02:35Joining us tucker, an eyewitness to the crash.

00:02:39What did you see?
00:02:40>> I was driving down the expressway and merging on a flyover from one expressway to another.
00:02:46As I was trying to merge to the right I looked up and saw a plane flying extremely low.
00:02:52I remember thinking, wow, that's low.
00:02:55Must be a new plane.
00:02:57I merged onto the ramp and saw it plow into the first floor of the building.
00:03:06>> Did you see the explosion?
00:03:07I imagine you can't believe your eyes?
00:03:09>> I was drinking coffee on the way to work, it was completely unexpected.
00:03:15You're like, wow, did that just happen?
00:03:18>> Did you see the fireball?
00:03:21>> Huge fireball, whole front of the building, glass exploded and huge plume of black smoke.
00:03:26>> Did you pull over, tucker?
00:03:28>> I did.
00:03:29I pulled over.
00:03:30I was on a flyover, which doesn't have a shoulder.
00:03:32I pulled over when I got to the bottom.
00:03:35There were 50 or 60 cars around with the different ways of the expressway and access road.
00:03:41>> Give me an idea when you say the plane was flying really low.
00:03:45We see the point of impact almost at the bottom of the building.
00:03:49>> This intersection I was going on was a high multi-level flyover.
00:03:53They have these tall light poles that have rings of light that light up the intersection at night.
00:03:58The reason I thought it was low, when I looked up, it was well below the lights that shine on the street.
00:04:04I'm like, wow, that's really low.
00:04:07When he banged, it was almost instantaneous it flew into the building.
00:04:12>> So far we've had no confirmation of anyone in that building being killed by this crash.
00:04:18Two people reited at the hospital.
00:04:19One perhaps on his way home treated for ske inhalation.
00:04:25When you look back to what you saw and the video now, is it stunning people walked out of that.
00:04:31>> Pretty amazing.
00:04:33When everyone topped poem were crying in their cars.
00:04:35Everyone was picking up their phones in shock.
00:04:38You could see after a few minutes, there was an access road at the side of the building, the frontage road.
00:04:43You could see people running and picking up debris off the road there.
00:04:47So I mean, it wasn't a small explosion, 50 gallons of fuel, it was a big fireball.
00:04:53>> You're right about that tucker, thank you for joining us and telling what you saw.
00:04:59Tucker is not alone.
00:05:00We're hearing from so many people.
00:05:04It was 10:00.
00:05:05That building houses so many offices.
00:05:07A lot of people were at work or driving on the highway next to the building.
00:05:10>> Tamron, I know you're familiar with texas, for a lot of us who haven't spent a lot of time in austin, this particular part of austin -- we associate austin with being the capital, the university of texas.
00:05:21How far away is it from that?
00:05:23>> I can't tell you how far from the capital.
00:05:25My uncle and aunt live five or six miles from here.
00:05:30I would guess maybe 20 minutes.
00:05:32Texas traffic probably an hour.
00:05:34To be honest, 183 there is always very busy.
00:05:38Early on when it was speculated this pilot might have been trying to make a landing, it didn't sound logical to me knowing at any given time that freeway, that highway is busy.
00:05:49So you're thinking to yourself, 00 in the morning would have been there for this pilot to make a safe landing, even if it were someone in an emergency situation.
00:06:01It would have been a bad incident to try to see a plane land on 183 the morning.
00:06:07That didn't jibe so well and the more details we learned there.
00:06:10You see, and I'll give you another idea, david are you see they never closed off 183 because of so many people using it.
00:06:17If they had closed off 183, even with black smoke going it would have been a nightmare as we speak now.
00:06:23That's an indication of houch how many people probably witnessed this.
00:06:26It stunning.
00:06:27That's why we're able to get so many witnesses like tucker, who we spoke with, who were probably there when he went down.
00:06:36>> Such a great point.
00:06:39We would expect, tamron, people throughout the day to provide accounts and photos they may have taken on their cell phones.
00:06:48At tamron noted kxan is providing coverage for us.
00:06:51Here is how one witness in the parking lot across the street from the crash described the moment of impact.
00:06:59>> The plane came flying over straight from the east.
00:07:01It curved in a little bit.
00:07:03It looked like there wasn't anything wrong wit.
00:07:06It sounded like it was running fine.
00:07:10The engines weren't smoking or anything.
00:07:12It was really low, almost to the power lines.
00:07:16It was clipping really sharply to the left.
00:07:20Honestly, we kind of thought it was somebody messing around, flying too low, trying to scare their copilot or whatnot.
00:07:28So we heard the explosion, and we looked over and saw the side of this building had fallen down.
00:07:34So yeah -- >> describe for me what that -- it had to be surreal.
00:07:40>> It definitely was because, like I said, we thought it was somebody joking around.
00:07:44We didn't think the plane was crashing when we saw it.
00:07:46It was so low, it was kind of one of those things I didn't see the person.
00:07:50It was close enough you could have seen the guy in it.
00:07:55>> Describe for me what you're feeling now as you see this.
00:08:00>> It's very surreal.
00:08:03It seems like one of those things you see on tv not something you actually see.
00:08:09>> What are you thinking about for the people inside that building right now?
00:08:13>> I've heard most of them are okay.
00:08:16A plane just hit their building.
00:08:18That's ridiculous.
00:08:1900 in the morning on a weekday.
00:08:22There must have been tons of people in there.
00:08:24>> Did you actually see the plane flying across 183?
00:08:29How low would you estimate that plane was?
00:08:31>> I don't know.
00:08:32Well, when it was back there, which is, what, half a mile or something, it was already -- we were worried it was going to hit it was already coming in way too low.
00:08:43>> By the way, 190 people worked in the irs in that building there and the latest again is that authorities believe two people were injured, one person with burns who had his back to a window, 25% of his body burned.
00:08:58Another person taken to the hospital with severe smoke inhalation.
00:09:01Still a question about whether there was a third person who was supposed to be in that office building not yet accounted for and the death of the pilot joseph stack.

00:13:07So, of course, the austin department of the texas home security agency was certainly put to the test in terms of how they responded this morning.

00:13:24Candace, first of all, how did things ondo from your perspective.
00:13:29>> Well, we were able to respond fairly quickly to the incident.
00:13:33Here and the city of austin, we are coordinating events.
00:13:38We have all the public safety entities here.
00:13:42We are activating our emergency operations center.
00:13:44>> What does that mean?
00:13:46When we look at an office building on fire, is there a specific person or group of people responsible for accounting for people that should have been in that office building?
00:13:57Another group responsible for coordinating with the fbi in how do you figure that stuff out.
00:14:04>> At this time we do not have the information of leasing, who was leasing out the building.
00:14:11What happens here locally as soon as an event of this magnitude occurs we come to the emergency operations center where we have fire, police as well as office of homeland security.
00:14:23We coordinate events.
00:14:26As the incident unfolds we expand and get any information out to the public, as well as to the ground that's needed.

00:14:33As far as the situation continues right now, I wonder if you can clarify.
00:14:37First of all, is the building on fire?
00:14:39>> No, the actual fire is under control at this time.
00:14:42They are -- the fire department is now draining down the building, which means they are running the water over the building.
00:14:50It has been contained.
00:14:52We have the texas commission for environmental quality as well as city of protection department on scene as well.
00:15:02>> Can you clarify that in terms of the two people injured and the one unaccounted for, has that been sorted out.
00:15:12>> There are two victims we know of that has been transported to the hospital.
00:15:16The one unaccounted for, that individual, we are still certainlying for that person.
00:15:21>> Okay.
00:15:24Then as far as the building itself, for the people in it, is it a complete loss, everyone that worked in the building, they will have to find new offices, a complete structural problem?
00:15:36>> The evaluation of the scene is continuing at this point.
00:15:40The construction stability is actually fine at the building.

00:15:56It's still amazing when you look at this and see in addition to the pilot killed maybe only two other injured despite the raging fire.

00:16:06It started at the family's home, a domestic dispute.
00:16:11If these accusations are true, he set his own home on fire with his wife and child in there.
00:16:16They were rescued by the neighbors.
00:16:19More on the pilot who is believed to have intentionally felony the plane into the office building.
00:16:26Joseph stack wrote an anti-government manifesto venting his anger over the irs.
00:16:31We have a few more postings from that.
00:16:33Let me show you this one, why is it a handful of thugs and plunderers can commit awe drafts -- here is another portion from that.
00:17:15We talked a lot about, this david, this anger that people have, some people have, and they direct it at the government.
00:17:24In this case, this guy goes from health care.

00:23:14A man by the name of joseph stack apparently angry at the federal government and irs in particular set his home on fire this morning and then went to the airport, got an aircraft he tends to fly, a cessna, single engine and crashed it into a federal office building that houses the irs, despite the fact the building, several floors were engulfed in flames, authorities are saying only two people were injured, one with smoke inhalation and another with burns as a result of being near a window.
00:23:43There's another person that is unaccounted for at this hour and of course the pilot, joseph stack, who was killed.
00:23:49When you think about the number of people working in that office building, 190 in the irs building itself, irs office itself, a minor miracle they are saying in austin that more people were not hurt or killed.

00:24:28When I listened earlier, i heard, for example, a number of claims from dick armey and all the things that are wrong with president obama personally.
00:24:37Is that the tone, the personal issues or has most of it been about policy?
00:24:42>> David, it has been a lot of red meat in this conference.
00:24:45It happened today, will happen friday and saturday over three days as this conference takes place in washington, d.c.

00:24:55Similar liberal events we have and often see, similar really tough words.

00:25:00There was some talk of policy, keeping tacks low, advocating for free enterprise.
00:25:06Mostly today's activities was a good way for republicans who now feel very good about their electoral chances in november to whack the president.

00:25:23Mark, out of people that go to these conferences, you hear them, obama administration, want to take away our personal freedoms, what are they getting at?
00:25:34What are the sorts of things that get them riled up.
00:25:38>> David, what's going on when you look at conferences, breakout panels, it does seem this conservative political action conference is trying to co-op the movement.
00:25:49The group that hosts it is the american conservative union, one of the more established conservative groups in washington.
00:25:56A lot of messages, the pam's really harp to the tea party movement, the declaration of independence.
00:26:06Republicans are trying to tap into the tea party vein, to energize folks to do the best they can in upcoming elections.

00:31:07In any case, can you imagine when this first happened about five hours ago, a lot of news organizations were scrambling to figure out was this intentional, was it not, who was the pilot.
00:31:19The reuters news agency based in houston has been all over this story trying to piece together what we know about joseph stack, the alleged pilot who apparently set his home on fire.
00:31:37Chris from reuters, what have you learned about joe stack?
00:31:42>> Yes, thank you, david.
00:31:44Joe stack, apparently a software engineer.
00:31:49Long time worked in the southern california area before moving recently to austin, texas, to continue his work as a software consultant.
00:32:01Apparently according to the note that is linked with him, ran afoul of tax agency, the irs, apparently has, according to two federal officials we spoke with, deliberately possibly flown his plane into a building in austin.
00:32:26>> Looking at the manifesto, so interesting, yes, he had to pay tens of thousands of dollars over the years because of penalties and audits but sounded like he was making a lot of money recently.
00:32:36And that in the course of having his taxes done by an accountant yet again, at a time when he was doing well, hoping to save again for retirement, he's told, no, you have penalties you have to pay.
00:32:48It's as this that sent him over the edge.
00:32:51Does it seem like reading the manifesto and how you matched with other information, that it was consistent.
00:32:59>> The manifesto did make a reference to, quote, a boatload of income, a new business asset, a pan okay, which I had no idea how to handle.
00:33:10In the manifesto, it does mention the irs by name, so it does seem to point to motivation on his part there.
00:33:19>> Chris, as far as trying to circle back and talking to colleagues of this joe stack or friend, have you been able to pick up anything from them?
00:33:28Any red flags that might have existed or strange behaviors in the weeks leading up to this?
00:33:34>> Not so far, david.
00:33:36From what I've learned, stack has a new wife, as he mentioned in his note, who is an area musician in austin, which is a pretty vibrant music community, as well as a 12-year-old child.
00:33:51Both of them were apparently in the house this morning when a fire was lit.
00:33:59Both escaped safely, apparently.

00:34:07>> As you can imagine, whenever there's an aircraft crash, something like this, the federal aviation administration, department of transportation also pool their resources to try to piece together about what they may know about what happened, who may have seen something at an aircraft, check it out, whether they got permission, flight plains.
00:34:30Joins us mary schiavo.
00:34:37As far as how many people had contact with him at the airport, how many would be valuable to investigators essentially trying to close this case?
00:34:47>> The problem is in an airport where you are already known and where you have an aircraft and where they know you as a pilot, there aren't a lot of red flags that go up.
00:34:56Our federal aviation regulations and security regulations at private airports to private planes are aimed at weeding out people that don't belong there.
00:35:07You're supposed to be vigilant, watchful.
00:35:10People might not have noticed anything strange.
00:35:13He was a pilot, had a plane he owned or had full access to.
00:35:17There wouldn't be a lot of red flags.
00:35:19The only thing people would be able to report is if he saudi anything in recent days, said anything when he took off.
00:35:26Very little time to stop him, though.
00:35:29>> With these malplanes, he's not required to file a flightplan, if he doesn't want to?
00:35:35>> That's right.
00:35:35It was a clear day.
00:35:38He was clearing not flying insty if he entered the traffic area of a controlled tower, air traffic control area, positive control area, would he be required to?
00:35:52Unfortunately once he took off, if you're not going ifr filing a flightplan, you don't have to.
00:36:01Once you're up there, you're free to go in the sky where you choose.
00:36:06>> Does this change anything how the faa handle now private pilots at these airports or you just have to hope the percentage of people who want to kill themselves will take other people by aircraft is in finities mally small.
00:36:23>> This is a tough one for ntsa and federal aviation administration.
00:36:29All the regulations are aimed at finding someone who doesn't belong, aimed at finding someone who might steal an aircraft.
00:36:36Where you already have a pilot's license and a plane, that's more difficult.
00:36:40Obviously you can require more background checks, but in this case, since he didn't have any kind of -- at least as far as we know, any type of memorial or psychological problem documented, no regulations on books about problems, if you pass your medical, very difficult.
00:36:59They will have to look into this, how they can flag people with potential problems when there's nothing on record.
00:37:05Aviation is a recordkeeping industry.
00:37:07We always look for the trail of paper.
00:37:09There's no trail of paper here aviation wise.
00:37:13>> You've had a number of pilots say there is a special culture, regard for aircraft and potential, whatnot, which makes it more sort of likely if someone did want to kill themselves they wouldn't use an airplane unless it was an act of terrorism.
00:37:27I wonder if you can get more into that.
00:37:29What is it about the pilot's community, air transportation community, that makes this thing in your view and the view of so many others, unlikely to happen very often?
00:37:39>> Unfortunately this has happened before.
00:37:43People are forgetting it happen in florida after infantrymen.
00:37:46A teenager took a plane and flew it into the side of a building.
00:37:49There have been many other instances.
00:37:52There have been instances where people suspected a suicide but hasn't been proven because the plane was destroyed or went do the ocean.
00:38:01I don't think it's as rare as people make it out to be.
00:38:04Pilots, like drivers of automobiles, et cetera, have problems.
00:38:07I don't think it's rare.
00:38:08I can think of several instances, including most recently because it was right after 9/11, the teen in florida who flew the plane into the building as well.
00:38:18Not as rare as you think.

00:42:23Congressman, what did you learn from the briefing you just got?
00:42:27>> Right now law enforcement is going through the building to make sure there's no one still left in the building.
00:42:35There were several injured taken to the hospital.
00:42:38They had severe burns.
00:42:39You know, when you look at the building, just the physical inspection, item out at the site right now, this is a small aircraft, piper cub.
00:42:48The amount of damage it did in terp of the gasoline catching the building on fire is really extraordinary.
00:42:59I think the efforts of the local ems, fire department and police department in saving lives was a very heroic action in austin.
00:43:09>> How do they explain how a small plane with 40 to 50 gallons could cause a fire this bag.
00:43:17Is there some indication it struck a gas line inside?
00:43:19A lot of people will ask this question.
00:43:22>> It has two tanks, as i understand it.
00:43:26He probably filled up two tanks.
00:43:28He's flying a short distance from the georgetown airport.
00:43:31Literally the plane bounced off the top of the car and hit the first floor of the irs building.
00:43:37Because it hit at a low point with all that gasoline, the fire started to go up.
00:43:45The building, not unlike the twin towers, what we experienced in that case.
00:43:50>> There was every indication this guy was acting alone.
00:43:52He wanted to take his own life an was willing to use an aircraft to do it and perhaps take out people he had complaints with in the irs.
00:44:00I know that you're the ranking member of the homeland security intelligence subcommittee.
00:44:05>> Right.
00:44:06>> As far as the terrorist plots to use an aircraft like this, and again this the first thing that comes in everybody's mind when they see the pictures, hear these stories, oh, it's terrorism.
00:44:17We know it wasn't terrorism in this case.
00:44:19What are the concerns out there as far as this type of method of terrorism?
00:44:23>> Dave, that's an excellent point.
00:44:26You point out this was not terrorist related.
00:44:29It was isolated.
00:44:30However, we have been very concerned for years about the private.
00:44:37We know the mastermind, lead hijacker was flying private aircraft.
00:44:44A gulf stream would be larger than this piper cub, could do extensive damage.
00:44:48What can be done to stop that?
00:44:51That's the real issue.
00:44:52What can we do to prevent something like this in the future if potential terrorists want to take an aircraft and slam it into a building.
00:45:04When you look at the damage done by one of the smallest aircrafts out there, the idea a gulf stream fly into the capital or white house, it's a scary prospect.
