00:57:30No. especially not this year.
00:57:32..
00:57:33..
00:57:36Are at higher risk of getting sick with the flu.
00:57:38That's why I'm getting vaccinated.
00:57:40I'm getting vaccinated.
00:57:41I'm getting vaccinated.
00:57:42I'm getting vaccinated.
00:57:44Vaccination is safe.
00:57:45..
00:57:47..
00:57:48.. my roommates...
00:57:50My friends.
00:57:51Get the facts at flu.gov.
00:57:52Together, we can all fight the flu.
00:00:01Literally have nothing right now.
00:00:04>> I want to be able to reach out and hug you and give you the -- you know, the big papa joe hug.
00:00:13But you know, we've got to get that little girl back any way we can, and we're doing everything we can.
00:00:20>> Dad, that's my only concern.
00:00:21I gave lee a statement.
00:00:22I want him to speak to whoever in the media, give them a statement specifically from me.
00:00:27He's going to give them an exact quote.
00:00:29She's my only concern.
00:00:31Next to caylee it's you guys.
00:00:33That's my only concern.
00:00:36>> What message do you want me to give to zanny and to caylee?
00:00:43What do you want me to tell zanny?
00:00:45>> That she needs to return caylee.
00:00:50>> What do you think her reasons are?
00:00:51>> Mom, I don't know.
00:00:55>> Okay.
00:00:56>> I forgive her.
00:00:57My only concern is that caylee comes back to us and she's smiling and she's happy and that she's -- that she's okay.
00:01:06>> Okay.
00:01:07What do you want me to tell caylee?
00:01:13>> That mommy loves her very much.
00:01:14And she's the most important thing in this entire world to me.
00:01:22And to be brave.
00:01:27>> I didn't get to thank you for all of your help and for everything that you've been doing.
00:01:32I know you know how I feel.
00:01:38But it's not something that i want to go without saying.
00:01:43You know how much I love you and how much I appreciate this more and more every day.
00:01:48You know, not only to you but to mom, to dad.
00:01:50I know that it's a heavy burden, and I wish that I could be there with you every minute of every day.
00:01:58I will be soon.
00:01:59I know that.
00:02:00I trust that.
00:02:01I can feel it.
00:02:02It's coming.
00:02:02It's getting closer.
00:02:06So we'll have our family back.
00:02:10>> I truly, truly love that little girl and miss her so much.
00:02:18And I miss you guys.
00:02:19>> I know, honey.
00:02:20We miss you too.
00:02:25>> I know lee's priority list, we went through things, and i know caylee's at the top of everybody's priority list.
00:02:31I'm the last on mine right now.
00:02:33>> I know you are.
00:02:34I know you're the last on your list.
00:02:36Because you're just like me.
00:02:39Are you protecting caylee or are you protecting me or are you protecting whom?
00:02:45I know you're -- >> lee and I made an agreement.
00:02:48I'm going to start writing letters.
00:02:50I'm going to do it today.
00:02:51I'm going to write individual letters to each of you, send them through the mail, through the jail mail -- >> casey-i don't want to wait through the mail, darling.
00:03:00>> I'm protecting our family, yes.
00:03:05I'm protecting our family, yes.
00:03:07Not from anything that I've done.
00:03:11>> Someone threatening us?
00:03:17Someone threatening us?
00:03:21>> Mom, just leave it at that, please.
00:03:23>> Okay.
00:03:23>> For right now just leave it at that.
00:03:25>> Okay.
00:03:26I trust you.
00:03:34>> No one has once said anything for me, a voice, that I love my daughter, that I want her safety, and that she and the rest of my family is my only concern.
00:03:47>> I'm writing this down.
00:03:48It's literally going to be a quote.
00:03:54>> All I want is to see her again.
00:03:59To hear her laugh, to see her smile, and to just be with our family.
00:04:10Nothing else matters to me at this point.
00:04:12>> Understand that we all feel that way.
00:04:14Every one of us.
00:04:16Okay?
00:04:16>> I know.
00:04:17But again, they've been hearing that from you, from her uncle, from her grandparents, from -- >> I've been praying every single day for insight and everybody's thoughts and everybody's feelings.
00:04:30So I know where you stand and where you're coming from.
00:04:32And I know where you're sitting right now.
00:04:35And mom and lee and joe schmo walking down the block that's seeing this every day on the media for the last month.
00:04:42I can understand everybody else's side in this.
00:04:43But the worst part is that nobody can see my side.
00:04:46And I have to keep my mouth shut.
00:04:48I have to keep my mouth shut about how I feel and with everything else because all i need to do is give the media more stuff, for the detectives and whoever else to throw back in my face when this goes to trial.
00:05:01>> I love you.
00:05:03>> I know.
00:05:12I'm trying to stay strong for you.
00:05:14>> And you're doing such a great job, mom.
00:05:19You have.
00:05:19Everybody has said that.
00:05:20Everybody tells me every day.
00:05:22>> I've tried so hard, but it's getting harder every day.
00:05:24>> You have to stay as strong as you can, mom.
00:05:27You have to.
00:05:28I know it's hard.
00:05:29Trust me.
00:05:31I know -- I know better than anyone right now.
00:05:34>> I know you do.
00:05:36>> We're going to get our little girl back.
00:05:39She's going to be just as she was.
00:05:43>> I'll never let anybody outside the family -- >> I know.
00:05:46Trust me, I've said the same then.
00:05:48I'm going to be the crazy overprotective mom at that point, but I don't care.
00:05:51I think it's well warranted, well deserved.
00:05:53>> You've always been protective mommy.
00:05:56>> Yeah, well, like I said, the crazy.
00:05:59I won't let her out of my sight.
00:06:04We'll figure everything out, but I want it to overlap where we can all have our time.
00:06:08And I'll be with her.
00:06:10She's not just my little girl.
00:06:14And I know -- I mean, she's my baby.
00:06:16She'll always be my baby.
00:06:18But she will always be your baby and dad's baby and lee's baby.
00:06:23She's our little girl.
00:06:24>> We miss her.
00:06:26We love her.
00:06:28I miss her, I love her dearly.
00:06:31And I want nothing more than for her to come home and to be safe.
00:06:34And to be where she belongs with her family.
00:06:41It's obvious that we'll stop at nothing to get her back.
00:06:45Because I know in my heart, i know in my gut, I know with every ounce of my being that we will be with her again.
00:06:53>> Dad, I don't care about all this other stuff.
00:06:56I mean, I don't care about the media.
00:06:59I don't care about what people have been saying about me.
00:07:01That doesn't matter.
00:07:05Because I know it's not true and everyone that knows me knows it isn't true.
00:07:07All I want is caylee home.
00:07:09But I want to be there when she comes home.
00:07:11>> How did you get through last saturday?
00:07:14>> I didn't.
00:07:18I spent the day almost completely by myself.
00:07:22With my head under the covers.
00:07:26I read my bible almost the entire day.
00:07:28It was miserable.
00:07:32It was completely and utterly miserable.
00:07:35Just like I have been the entire time, that was the first time outside of our visits that I've really shown any emotion.
00:07:41And I was open, and I didn't care just because I couldn't hold anything back.
00:07:44I broke down.
00:07:46It was the first time that i truly, truly broke down.
00:07:50It hurt, and I'm still recovering from that.
00:07:55Hearing about the fact that mom was making chili and there was probably a bunch of people at the house.
00:08:04>> You have to keep your strength as much as you can.
00:08:05>> I know.
00:08:07Because she's going to need us when she comes home and then you're going to need us when you get home.
00:08:12>> I'll be fine.
00:08:13Because I have you guys.
00:08:14I have you guys even if it's not in physical form at the moment.
00:08:17I have your love and support.
00:08:20I have everything that I -- >> she doesn't see us.
00:08:23She doesn't see us.
00:08:25>> She's going to need all of us.
00:08:27So we all need to be strong.
00:08:29You need to take care of yourself.
00:08:30I was just telling dad, like i told lee, you need to eat.
00:08:33You need to sleep.
00:08:37>> This person is not going to hurt caylee-s she, casey?
00:08:40She's not going to hurt caylee, is she, honey?
00:08:45>> No.
00:08:45I told you in my gut I know she's okay.
00:08:49I can feel it, mom.
00:08:50I know she's still okay.
00:08:51>> When we come back, tot mom comes face to face with detectives.
00:08:54All caught on video.
00:12:24>>> Tonight, there's a battle brewing.
00:12:26To determine if tot mom will get the death penalty.
00:12:29Will tot mom's own words be used against her?
00:12:33We've obtained hours of footage of tot mom, casey anthony, spewing story after story.
00:12:40Take a look.
00:12:41Cops arrest anthony and immediately begin questioning her.
00:12:44It's all on tape.
00:12:46>> Is your daughter in a better place?
00:12:48>> No, she's not.
00:12:49>> Are you worried about her?
00:12:51>> I'm absolutely petrified.
00:12:53If she was with her family right now, she'd be in the best place.
00:12:58She's not.
00:12:59She's with someone that i absolutely do not trust.
00:13:02And that I'm absolutely scared that -- >> that you don't trust yet was baby-sitting your daughter for a year?
00:13:08>> I don't trust her now.
00:13:09Because of what happened.
00:13:11>> What point did you stop trusting her?
00:13:13>> The moment that her phone was cut off and I couldn't get in contact with my daughter.
00:13:18>> So you thought then, man, something ain't right?
00:13:21>> Something's wrong.
00:13:22>> And when you started thinking that something was wrong, which police agency did you call first, us or the city police, or who did you call first?
00:13:30Who did you go to for help first to help try to find her?
00:13:34>> No one.
00:13:35>> No one.
00:13:36Okay.
00:13:36All right.
00:13:37Okay.
00:13:38Well, I'm glad we got that straightened out.
00:13:41>> You purposely misled us.
00:13:43This was all an attempt to help find your daughter, right?
00:13:46>> No.
00:13:46>> That makes sense to you, correct?
00:13:48>> Again, in a backwards sort of way, yes.
00:13:52>> In a backwards sort of way.
00:13:53>> I'm coming back to places that are familiar to me, that i know are familiar to her.
00:13:57>> Does that make sense to you?
00:13:59It makes sense to you that I'm trying to help the police find my daughter by giving them a bunch of bad addresses?
00:14:04That makes sense to you?
00:14:08>> That's what I said, yes.
00:14:10>> No, no, I'm asking you, that makes sense to you?
00:14:12My attempt -- >> that part of it, no.
00:14:14>> My attempt to help him find my child, okay?
00:14:17What I've done to try to help him find my child is I've given him a whole bunch of addresses to go to that are bad addresses.
00:14:22That's what I did to help him try to find my child.
00:14:25That makes sense to you?
00:14:26>> Everything you've told us is a lie.
00:14:28You're looking me in the eyes.
00:14:29You're looking at -- everything you've told us is a lie.
00:14:32Every single thing.
00:14:32And you -- >> no, it isn't.
00:14:34>> Yes.
00:14:34And you can't keep sitting here and telling us the same thing and getting constantly over and over and over again we're disproving everything that elling us.
00:14:41You're telling us that you've lied to us.
00:14:42You're telling us you're giving us misinformation.
00:14:44Everything you're telling us.
00:14:46Okay?
00:14:46This needs to end.
00:14:47>> The truthful thing -- >> this needs to end.
00:14:50>> -- Is I have not seen my daughter.
00:14:52The last time that I saw her was on the 9th of june.
00:14:55>> And what happened to caylee?
00:14:56>> I don't know.
00:14:57>> Sure, you do.
00:14:58You need -- >> I don't know.
00:14:59>> Listen.
00:15:00Something happened to caylee.
00:15:01We're not going to discuss the last time you saw her.
00:15:04I'm guessing something bad happened to her some time ago and you haven't seen her.
00:15:08So that part is true if you say you haven't seen her because she's somewhere else right now.
00:15:12>> She's -- >> so you're more afraid of your mom's reaction than you are if you ever see your daughter again?
00:15:18>> No, I'm absolutely petrified.
00:15:19Absolutely petrified.
00:15:20I know my mom will never forgive me.
00:15:23I'm never going to forgive myself.
00:15:25Because there's that chance that I might not see caylee again, and I don't want to think about that.
00:15:32>> Do you think the result will be different?
00:15:37>> Absolutely.
00:15:37A lot of different aspects.
00:15:40That's the conversation I've had not only with my attorney but with my family.
00:15:45I mean, we alltill feel, I as a mom, I know in my gut there's -- the feeling is apparent, you know certain things about your child.
00:15:52You can feel that connection.
00:15:55And I still have that feeling, that presence.
00:15:57I know that she's alive.
00:16:02Whether you have a bucketload of evidence downstairs that contradicts that and says otherwise or all you have is speculation.
00:16:11Or nothing at all.
00:16:13I mean, whatever it is, if there's still that chance, with all these tips that have come through, I know it's been speculated how many thousands of tips have come through.
00:16:21>> There's been a lot.
00:16:22>> There have been a lot.
00:16:24>> I have an open mind when it comes to things.
00:16:27I try to keep an open mind when it comes to things.
00:16:29But if I'm innocent, that's as far as that goes.
00:16:34And as far as anything else on top of that, I'll take this as far as I need to to prove my innocence.
00:16:42Which I guess is my point in all of th.
00:16:45>> When you say you'll take it as far as you need to to prove your innocence -- >> with -- >> -- what do you mean?
00:16:52>> Serving the indictment today and the warrant for my arrest and everything else.
00:16:55I'm not running.
00:16:57>> They're finally trying to be nice to us again.
00:16:59So -- >> good.
00:17:00They need to be nice to you.
00:17:01Because if they're not, don't talk to them.
00:17:04>> Yeah.
00:17:06>> Serious.
00:17:07I mean, I want their help as much as we can get it.
00:17:12But they need to help us too.
00:17:13>> I know.
00:17:14>> It needs to go both ways.
00:17:15It can't be one-sided.
00:17:16>> I know.
00:17:18>> I'll try to help them in whatever way that I can.
00:17:20But if they come in here attacking me, they're not getting [ bleep ].
00:17:25Story.
00:17:25>> The tot mom investigation started with a series of frantic 911 calls.
00:17:31We have the 911 calls.
00:17:34As tot mom in her own words, next.
00:21:18>>> One month.
00:21:19That's how long it took for tot mom to even admit her daughter, caylee, was missing.
00:21:24Listen as tot mom tells a 911 operator she knows who has caylee.
00:21:30Even claiming she spoke with caylee briefly.
00:21:34Will those words come back to haunt tot mom at trial?
00:21:37>> Is your daughter there?
00:21:39>> I'm on the phone with them.
00:21:40>> Is your daughter there?
00:21:41>> Yes.
00:21:42>> Can I speak with her?
00:21:46Do you mind if I speak with her?
00:21:47Thank you.
00:21:48>> I called hem two hours ago.
00:21:50They haven't gotten here.
00:21:52Casey finally admitted that zanny took her a month ago and she's been trying to find her.
00:21:56>> Ma'am.
00:21:59Ma'am?
00:21:59>> Casey, they want to talk to you.
00:22:04Answer their questions.
00:22:04>> Hello?
00:22:06>> Hello?
00:22:06>> Yes.
00:22:07>> Hi.
00:22:08What can you -- can you tell me what's going on a little bit?
00:22:11>> I'm sorry?
00:22:11>> Can you tell me a little bit what's going on?
00:22:13>> My daughter's been missing for the last 31 days.
00:22:18>> And you know who has her?
00:22:20>> I know who has her.
00:22:21I've tri ctact her.
00:22:22I actually received a phone call today now from a number that is no longer in service.
00:22:28I did get to speak to my daughter for about a moment.
00:22:34For about a minute.
00:22:35>> Okay.
00:22:35Did you guys call and report a vehicle stolen?
00:22:38>> Yes.
00:22:38My mom did.
00:22:41>> Okay.
00:22:42So is it a vehicle stolen too?
00:22:44>> No.
00:22:45This was my vehicle.
00:22:47>> What vehicle was stolen?
00:22:48>> It's a '98 pontiac sunfire.
00:22:52>> Okay.
00:22:52I have deputies on the way to you right now for that.
00:22:58But now your 3-year-old daughter is missing.
00:23:00Caylee anthony.
00:23:01>> Yes.
00:23:02>> White female.
00:23:02>> Yes, white female.
00:23:03>> 3 Years old.
00:23:068-9-2005 Date of birth?
00:23:08>> Yes.
00:23:09>> We'll have a court order to get her.
00:23:11If that's the way you want to play.
00:23:13We'll do it.
00:23:13And you'll never -- >> that's not the way I want to play.
00:23:16>> Well, then you have -- no, I'm not giving you another day.
00:23:20I've given you a month.
00:23:22>> And you last saw her a month ago?
00:23:24>> 31 Days.
00:23:25It's been 31 days.
00:23:28>> Who has her?
00:23:29Do you have a name?
00:23:31>> Her name is zenaida fernandez gonzalez.
00:23:37>> Who is that?
00:23:39Babysitter?
00:23:39>> She's been my nanny for bay year and a half.
00:23:42Almost two years.
00:23:46>> Why are you calling now?
00:23:47Why didn't you call 31 days ago?
00:23:49>> I've been looking for her and have gone through other resources to try to find her, which was stupid.
00:23:56>> Okay.
00:23:56Can you give me the name of the nanny again?
00:23:59Like spell it out for me.
00:24:00>> Zenaida.
00:24:07Z-e-n-a-i-d-a.
00:24:08>> Last name?
00:24:08>> Fernandez.
00:24:10>> Fernandez?
00:24:11>> Hyphen gonzalez.
00:24:18I think the officers are here.
00:24:23>> When we come back, her daughter's missing.
00:24:27But behind bars tot mom seems more worried about her own image.
00:27:17>>> Right now the battle raging.
00:27:20Will tot mom get the death penalty?
00:27:23Her defense desperately wants to ban hundrs of statements and photos of tot mom partying, some taken in the days and hours after little caylee goes missing.
00:27:35Will tot mom's own words be used against her at trial?
00:27:38Take a listen to this jailhouse video.
00:27:40It's a phone call between tot mom and her family.
00:27:45She's actually complaining her image is being tarnished.
00:27:51It's nothing but me, me, me, me, me, me.
00:27:54>> I want to bring up this thing about -- about you know, you being the boss.
00:27:58You're the one that can control everything.
00:28:00>> No, I -- dad.
00:28:02Please.
00:28:02>> Sweetie, I'm not trying to get you upset.
00:28:05I'm trying to talk to you.
00:28:06>> No, but I am upset now.
00:28:08>> Please.
00:28:08>> I'm completely upset.
00:28:09One, the media's going to have a fricking field day with this.
00:28:12>> No, they're not.
00:28:14Listen -- >> how am I supposed to take this?
00:28:16Let me speak for a second.
00:28:18Dad, I let everybody talk.
00:28:19>> Okay.
00:28:20>> They're not releasing it -- well, I hope not.
00:28:23I'll keep saying whatever I have to about the police.
00:28:25So they don't want to go.
00:28:26>> Here's mom.
00:28:27>> Can someone let me -- come on!
00:28:29>> Casey.
00:28:30Hold on, sweetheart.
00:28:31Settle down, baby.
00:28:32>> Nobody's letting me speak.
00:28:33You want me to talk and -- >> all right.
00:28:37I'll listen to you.
00:28:37>> Give me three seconds to say something.
00:28:39>> Go, sweetheart.
00:28:41>> You guys have given everything to the police.
00:28:43They're not helping us.
00:28:44It's obvious.
00:28:45We know their intentions.
00:28:47So I'm sorry.
00:28:48I've helped in every way that i possibly can since the day I got here.
00:28:54>> Okay.
00:28:54Well, let me -- >> they didn't even give me 24 hours to help them, the police, without putting me here.
00:29:02So it's obvious where everybody's intentions lie.
00:29:04I know you guys want caylee.
00:29:05I want caylee more than -- than anybody can understand.
00:29:08But I can't do anything.
00:29:12I can't do anything from where I'm at.
00:29:14>> I want to openly thank not only our family but our friends and the community for, you know, their unconditional love and support.
00:29:30>> Okay.
00:29:30>> I want to thank, obviously, all the charities that are -- that are donating their time and their efforts and their resources to help us.
00:29:45I want everyone to keep caylee and our family in their prayers.
00:29:50And if there's anyone that has any information, please to come forward without haste.
00:29:56>> None of us have anything right now, casey.
00:29:58>> You guys have each other.
00:30:00You're sitting next to dad.
00:30:01You still have lee.
00:30:02You have access to our community, to our family and friends, to our house.
00:30:09You're taking for granted the fact that I have no one to comfort me but myself.
00:30:18And the occasional visit, which has to be business for the sake of finding caylee.
00:30:26So yeah, I may look like I'm in charge.
00:30:30Wrong.
00:30:30I'm completely pushed away from everything.
00:30:35This is seriously the first time that I've been angry, that I've been this frustrated to where I -- I can't even think straight at this moment.
00:30:42Throughout this entire thing i was pissed off that day at the police station.
00:30:46I was mad when all of that happened.
00:30:49But I tried to look at things objectively.
00:30:53And this entire time I haven't sat in my room for the entire month and been mad.
00:30:57Not once.
00:31:00Not one time.
00:31:01But right now this is the most agitated and frustrated that I've been, even when I've sat with jose and I watched that episode of "nancy grace" and the stuff that was being said about mom and being said about me and him and everybody else and stuff that I've heard.
00:31:16It's frustrated me, but I've let it go.
00:31:21Right now I'm so hurt by everything, I don't even know what to say.
00:31:25And I hate to say that.
00:31:28>> Well, I'm not trying to upset you, and neither are mom.
00:31:31We're not trying to.
00:31:32And if we are, I'm sorry for that.
00:31:36>> I know that's not your intention.
00:31:37You have to understand where I'm coming from in this.
00:31:40And obviously, none of you are.
00:31:42By still expecting me a month literally out of the loop to have some sort of new insight on stuff?
00:31:49I mean, really?
00:31:50>> Everybody is looking for her.
00:31:53Are we going to be able to find her, do you think?
00:31:55>> I hope we can, mom.
00:32:00Now, I didn't get a chance to ask lee.
00:32:02>> Can you look up a little bit more?
00:32:04Raise your eyes up a little bit.
00:32:06There you go.
00:32:07So -- no.
00:32:08Look straight up so I can look into your eyes, darling.
00:32:11Thank you.
00:32:12You know I need to do that.
00:32:14It's okay to cry, casey.
00:32:16It's all right, love.
00:32:19We've all been crying.
00:32:21I know the pictures with caylee in zanny's apartment.
00:32:26Is zanny's apartment the ones with the drums?
00:32:30>> She had a drum set, yes.
00:32:32>> The one in the picture?
00:32:36>> I think there are even other pictures.
00:32:38I told lee to look through everything.
00:32:40>> Okay.
00:32:40Is that zanny's apartment?
00:32:44Because I know whose apartment it is.
00:32:46Is it zanny's apartment?
00:32:47>> That exact apartment, no, it was ricardo's apartment.
00:32:50It was set up a lot like zanny's apartment.
00:32:57>> Okay.
00:32:58Do we have any pictures of zanny's apartment?
00:33:00>> Mom, lee and I already talked about this.
00:33:04I don't know -- it could be on the disk at home.
00:33:06I don't know.
00:33:07>> Being as strong as I can considering the situation.
00:33:11It's just hard.
00:33:12It's just very hard.
00:33:17>> I know.
00:33:18I can understand.
00:33:19>> I just want to go home.
00:33:26Every day I wake up I'm just hoping and praying that I get to go home.
00:33:31I just want to be with you guys.
00:33:34I just want to help find her.
00:33:36Because I feel a little hopeless.
00:33:38I feel a little helpless here.
00:33:40I mean, honestly.
00:33:41Not really hopeless but more helpless.
00:33:44Because I can't do anything from where I'm at.
00:33:52Oh, god.
00:33:54My heart is aching because i just want to be back with our family.
00:34:04In my gut every day stronger and stronger I know we're going to see caylee.
00:34:09I know she's coming home.
00:34:11>> Our family's broken.
00:34:12We want to have that fixed.
00:34:14We know what that means, to have our family broken apart by something now.
00:34:18By tragedy.
00:34:19We don't want this to any longer be a tragedy.
00:34:27I don't want to be one of those thousands of parents that has to deal with the possibility of never seeing their child again.
00:34:36With the potential of knowing that their child's alive and that they're with someone else.
00:34:41The thought of that every day makes me sick.
00:34:44>> When we come back, more evidence the defense wants thrown out of court for the jury to never see or hear.
00:34:52This as the battle rages as to whether tot mom will face the florida death penalty.
00:38:28>>> The best witness for the state?
00:38:31Casey anthony herself.
00:38:32In her own words.
00:38:32Take a listen to anthony in police custody claiming she wants to help find her daughter.
00:38:39But then immediately clams up and demands her defense lawyer.
00:38:45Why?
00:38:46>> Well, you'd have to excuse me for misunderstanding what we just went through.
00:38:51That wasn't us running.
00:38:53That was us trying to counteract the media for following us down to the jail.
00:38:58Because our only intention was to take me down it's jail to surrender me before this happened.
00:39:03That was the only thing we were trying to accomplish.
00:39:06You can ask mr. baez.
00:39:07You can ask my mom.
00:39:08You can ask anyone from the office.
00:39:10Even my bondsman, who was the driver.
00:39:14That was our only intention today.
00:39:18>> Okay.
00:39:21Entertain you on the formalities here.
00:39:29I just want to read the sheet to you and have you sign it.
00:39:30>> Okay.
00:39:30>> And then you've already waived we'll just do that again through the formalities.
00:39:33>> That's fine.
00:39:33>> Because I'd like to be as thorough as I can possibly be.
00:39:36>> I'm fine with that.
00:39:38>> Is that okay with you?
00:39:39>> Yep.
00:39:40>> Orange county sheriff's office waiver and affidavit form.
00:39:43You have the right to remain silent.
00:39:44Anything you say will be used in court as evidence against you.
00:39:46You're entitled to talk to an attorney now or have him present now or anytime during questioning.
00:39:51If you cannot afford an attorney, one will be appointed for you without cost.
00:39:55Do you desire to consult with an attorney first or have one present during this interview, yes or no?
00:39:58>> Yes.
00:40:00>> Okay.
00:40:01Go ahead and mark that.
00:40:04And if anytime -- we're done.
00:40:05>> Yep.
00:40:06>> You just cross the line right through that and give me your signature.
00:40:09Right on that line.
00:40:11>> You don't need me anymore?
00:40:13We're done in.
00:40:14>> We're done.
00:40:15D right there.
00:40:16And it is currently 4:22.
00:40:31Now, this is no secret.
00:40:33I have recorded that.
00:40:35>> Yeah.
00:40:36>> Not so it would end up on any television show but because I'm thorough.
00:40:39>> So there's no question.
00:40:40Exactly.
00:40:40>> No question.
00:40:43So I can take my recorder and turn it off.
00:40:45>> Yeah.
00:40:46>> Okay.
00:40:46>> I expected you to record that anyway.
00:40:49>> I've identified myself to you while you're in custody.
00:40:52>> Yes.
00:40:53>> And you have -- you've signed this, you want your attorney present.
00:40:57>> Yes.
00:40:59>> Through that conversation we've agreed -- >> yes.
00:41:02>> Express that to me again so i have full understanding before i get on the phone with him.
00:41:05>> We have discussed before that we have no problem sitting down together, him and i, and speaking with law enforcement or listening to all the questions that you have and discussing it and then we go from there.
00:41:17>> Okay.
00:41:18>> And that's -- there's been no success with that so far?
00:41:20>> Nobody's taken us up on that.
00:41:22>> So we're going to open that window right now.
00:41:26>> Okay.
00:41:27>> And hopefully we can make something happen.
00:41:35Because ultimately, I think we have the same interest.
00:41:38>> Mm-hmm.
00:41:38>> Finding your daughter.
00:41:41>> Do you have any interest -- >> I've had interest in helping law enforcement from the beginning.
00:41:46Unfortunately, my hands were literally tied.
00:41:48And I was put in a position where someone's trying to trick a confession out of me and -- >> I -- >> -- that's not going to happen.
00:41:56>> Now, don't go there.
00:41:57You know as far as how we have to do things, and I would want to do things aboveboard and straightforward.
00:42:03I would want to read you your rights and mirndize you.
00:42:09 baez, I'm sure, has gone through that thoroughly with you, coached you on what to say, which is fine.
00:42:12That's his right.
00:42:13That's your right.
00:42:14But I as a law enforcement officer still am afforded the right to approach you as a suspect -- I'm not going to sugar cote it.
00:42:22That's one thing you'll never get with me, is a mind game.
00:42:24>> I appreciate that.
00:42:25>> It's been a long day.
00:42:26>> It has been.
00:42:27>> How was my dad this morning?
00:42:30>> He had a hard time.
00:42:32>> Yeah.
00:42:32>> Honestly.
00:42:36>> I got a chance to tear him talking.
00:42:39I spoke to him last night and this morning for just a quick second before he left.
00:42:42>> Yeah, I talked to him this morning for a little bit.
00:42:45He was with mark.
00:42:46He was really struggling.
00:42:48I mean, I can imagine him having a hard time.
00:42:51He was being called in to -- to essentially provide testimony to indict you.
00:42:58>> Mm-hmm.
00:42:59>> And he was really struggling with that.
00:43:03>> Yeah.
00:43:04>> And I felt bad for him, to be honest with you.
00:43:06I surely did.
00:43:07>> I told him last night, I know he was subpoenaed and under the law he had to answer whatever questions were asked and I told him to do what he had to do at that point and if he didn't he'd be held in contempt of court.
00:43:19I didn't want to see that happen.
00:43:21So -- >> what did he say?
00:43:22>> He just hugged me and told me that he loved me and to know he was struggling with it even last night.
00:43:29>> I think it was probably more so this morning.
00:43:32>> Yeah.
00:43:32I could see that with the little bit that I saw from the media, from the pictures and the little bit of footage that they had.
00:43:38>> You guys watched it on tv?
00:43:40>> Well, we watched it online a little bit.
00:43:42>> Really?
00:43:43>> Yeah.
00:43:44I try to stay away from the tv as much as possible.
00:43:46At least with the internet I can scroll through, read what i want, and then just get rid of it that much faster.
00:43:53>> Just a random question.
00:43:54>> Sure.
00:43:55>> Are there cameras in all of the rooms or -- >> movie freaking clue.
00:43:58I've never been in this part of the building.
00:44:00So my guess would be yes.
00:44:01>> Yeah.
00:44:01That's what I was thinking, too.
00:44:03My mom wasn't aware that there was a camera in the room, i guess, when she met with milledge and I forget who else.
00:44:14And the big interviews that were released to the media.
00:44:17And she was infurlted.
00:44:19You would think that's something you should be told.
00:44:22But you don't have to be.
00:44:23>> Right.
00:44:23The law is the law.
00:44:24>> Yeah.
00:44:25>> Here is my question.
00:44:27I know this is a question that a lot of people have asked.
00:44:31The grand jury and all that, it's supposed to be secret.
00:44:32But it was released to the media right off the bat.
00:44:35My dad hadn't even been subpoenaed, and that was released.
00:44:39>> The happenings are secret.
00:44:40What takes place within the room is secret.
00:44:42>> Yeah.
00:44:43But as far as when it actually is convened and, you know, pulled together, the witnesses and stuff like, that that's not also supposed to be secret?
00:44:49>> It depends on how they are subpoenaed.
00:44:52>> Okay.
00:44:53>> If you're subpoenaed under a regular court order, that's a public document.
00:44:57>> I'm not sure how that came through.
00:45:01>> But if the subpoena itself just a regular grand jury subpoena, that's public records.
00:45:04It doesn't say what it's for, it doesn't say what case it's in.
00:45:07It just says you're subpoenaed to appear before the grand jury.
00:45:10>> Well, them announcing that there was going to be a grand jury, and obviously my name was thrown out, they knew who the grand jury was for.
00:45:18>> Who threw your name out?
00:45:20>> The media said that it was from an inside source, meaning in here.
00:45:27So -- that's where they all say -- >> I can tell you what I think of the media and what I think of people who leak stuff to the media.
00:45:34>> I think it's garbage.
00:45:35Yeah.
00:45:35I agree.
00:45:37>> That doesn't make it any less necessary.
00:45:46Without them -- >> mm-hmm.
00:45:47>> I'll be quite honest.
00:45:50Without the media we don't find a quarter of the kids that we -- >> oh, I agree.
00:45:52It helps.
00:45:53The exposure has helped bring in so many tips for my daughter.
00:45:56>> But at the same time I agree what it creates is it creates a monster that otherwise isn't necessary.
00:46:02>> Exactly.
00:46:03>> If I read you your rights and we take the time to do that and -- you've met, right?
00:46:08Have you two met?
00:46:09>> No.
00:46:10>> Casey, I'm scott.
00:46:11>> Nice to meet you.
00:46:14Okay.
00:46:14>> Okay.
00:46:15Take all that aggravation from prior contacts out of your mind.
00:46:19It's a different game.
00:46:20>> Mm-hmm.
00:46:21>> I'm a homicide corporal.
00:46:26Fbi.
00:46:26Not john allen.
00:46:26Not yuri.
00:46:27Not the aggravation that the family -- that they see those two as.
00:46:31And I'm not minimizing their professionalism or anything they've done.
00:46:35>> Mm-hmm.
00:46:36>> I just want to approach it in a different manner.
00:46:39And today with wt was done today at the grand jury, regardless of accusations from everybody around, there's been people that have reviewe what it is so far, casey, we're at the end of the hallway.
00:46:50>> To an extent, yes, i understand that.
00:46:54>> We're -- we need you to determine what our next course of action's going to be.
00:46:58>> Okay.
00:46:59>> Really.
00:46:59Not saying you're in control of the situation.
00:47:01You're in control of your situation.
00:47:05That being said, I'd like to read you your rights and talk to you.
00:47:08Is that something you're interested in?
00:47:10>> I would like to do that on the basis of with my attorney-f that's possible.
00:47:17>> You'd want him there?
00:47:18>> Yes.
00:47:18>> When we come back, casey anthony caught anthony caught on video.
00:47:22Will her own words be fired right back at her in court?
00:50:47>>> Tonight on "the joy behar show," rielle hunter, a woman who clearly treasures her privacy, tells her whole sorted story to a national magazine.
00:50:56Then charlie sheen headed to his home away from home today, an aspen courthouse, to answer domestic violence charges.
00:51:03We'll have the latest.
00:51:04And kate gosselin is getting $75,000 an episode to "dancing " EVEN tom DeLay didn't shake them down for that much.
00:51:13That and more after nancy.
00:51:16>> Despite thousands of pages of evidence, scores of witnesses, and dna evidence, tot mom casey anthony never stopped insisting she's innocent.
00:51:31>> Mom, I understand that.
00:51:33Do you understand my position on this?
00:51:34You guys expect me to have a thousand answers and I have nothing.
00:51:38I've been here a month.
00:51:40Out of contact with everybody except you guys on the rare occasion that I get to see you.
00:51:44And my attorney.
00:51:48Do you understand what am i supposed to learn from that?
00:51:51An-- what am I supposed to learn that?
00:52:01All I could do is backtrack.
00:52:02I can't backtrack on anything.
00:52:05A month I've been removed from the situation.
00:52:08You guys are not understanding my side on this, and I'm sorry.
00:52:11>> I understand.
00:52:15>> You're still asking me if there's anything that I can tell you that's going to help, that I'm the one that can do this.
00:52:21I can't.
00:52:22The opportunity was there that i probably could have helped.
00:52:24I'm trying.
00:52:26I was trying.
00:52:28There's nothing more that I can say or do until I'm home.
00:52:33Even then I don't know what i can do at that point.
00:52:35I can at least do something other than sit on my butt all day and breathe or look up stuff for my case.
00:52:42That has to be my focus right now.
00:52:44>> I found out my granddaughter has been taken.
00:52:50She's been missing for a month.
00:52:52Her mother finally admitted that she's been missing.
00:52:55Get someone here now.
00:52:57>> How long has she been missing for?
00:53:00>> I have not seen her since the 7th of june.
00:53:04My daughter has been missing for the last 31 days.
00:53:07>> Why didn't you call the last 31 days?
00:53:09>> There's something wrong.
00:53:11I found my daughter's car today and there smells like there's been a damn dead body in the car.
00:53:18>> I'm in the in control over any of this because I don't know what the hell is going on.
00:53:22I don't know what is going on.
00:53:24My entire life has been taken from me.
00:53:27Everything has been taken from me.
00:53:31You don't understand.
00:53:32Everybody who wants me to have answers, I don't have answers because I don't know what's going on.
00:53:40I don't have anyone to talk to except jose.
00:53:43I can't even say anything to you guys besides telling you that i love you.
00:53:48I want caylee.
00:53:49Things like that, and that's not even get put on the air, which it should be.
00:53:54It's everything else.
00:53:55It's everything that I'm not saying.
00:53:58It's why I haven't been calling.
00:54:00It's why I haven't been taking calls.
00:54:03I'm trying to make sure that I'm not going to give anybody anything else to throw against me.
00:54:11Even with me giving them nothing, they're still doing it.
00:54:15>> Let's stop and remember marine lance corporal adam crumpler, 19, killed iraq.
00:54:29Awarded national defense service medal, loved snowboarding, martial arts, dreamed of starting a martial arts school.
00:54:36Leaves behind grandmother emma and sister britney.
00:54:40Adam crumpler, american hero.
00:54:43Thanks to our guests but especially to you for being with us.
00:54:4600 sharp eastern.
00:54:48Until then, good night, friend.
00:00:00We've never met have more of an outlook on this than I do right now.
00:00:04It's really sad.
00:00:06That's really, really sad that i literally have nothing right now.
00:00:14>> I want to be able to reach out and hug you and give you the -- you know, the big papa joe hug.
00:00:24But you know, we've got to get that little girl back any way we can, and we're doing everything we can.
00:00:28>> Dad, that's my only concern.
00:00:30I gave lee a statement.
00:00:33I want him to speak to whoever in the media, give them a statement specifically from me.
00:00:35He's going to give them an exact quote.
00:00:37She's my only concern.
00:00:40Next to caylee it's you guys.
00:00:41That's my only concern.
00:00:46>> What message do you want me to give to zanny and to caylee?
00:00:51What do you want me to tell zanny?
00:00:54>> That she needs to return caylee.
00:00:58>> What do you think her reasons are?
00:01:00>> Mom, I don't know.
00:01:01>> Okay.
00:01:05>> I forgive her.
00:01:10My only concern is that caylee comes back to us and she's smiling and she's happy and that she's -- that she's okay.
00:01:20>> Okay.
00:01:22What do you want me to tell caylee?
00:01:23>> That mommy loves her very much.
00:01:25And she's the most important thing in this entire world to me.
00:01:29And to be brave.
00:01:39I didn't get to thank you for all of your help and for everything that you've been doing.
00:01:43I know you know how I feel.
00:01:46But it's not something that i want to go without saying.
00:01:52You know how much I love you and how much I appreciate this more and more every day.
00:01:57You know, not only to you but to mom, to dad.
00:02:00I know that it's a heavy burden, and I wish that I could be there with you every minute of every day.
00:02:06I will be soon.
00:02:07I know that.
00:02:08I trust that.
00:02:10I can feel it.
00:02:11It's coming.
00:02:11It's getting closer.
00:02:17So we'll have our family back.
00:02:21>> I truly, truly love that little girl and miss her so much.
00:02:25And I miss you guys.
00:02:26>> I know, honey.
00:02:28We miss you too.
00:02:34>> I know lee's priority list, we went through things, and i know caylee's at the top of everybody's priority list.
00:02:39I'm the last on mine right now.
00:02:41>> I know you are.
00:02:42I know you're the last on your list.
00:02:46Because you're just like me.
00:02:50>> I'll sit here as long as i have to.
00:02:53I don't care.
00:02:54>> I know.
00:02:54Are you protecting me or are you protecting caylee or are you protecting whom?
00:03:00I know you're -- >> lee and I made an agreement.
00:03:01I'm going to start writing letters.
00:03:03I'm going to do it today.
00:03:03I'm going to write individual letters to each of you, send them through the mail, through the jail mail -- >> casey, I don't want to wait through the mail, darling.
00:03:11>> I'm protecting our family, yes.
00:03:14I'm protecting our family, yes.
00:03:15Not from anything that I've done.
00:03:19>> Someone threatening us?
00:03:27Someone threatening us?
00:03:29>> Mom, just leave it at that, please.
00:03:31>> Okay.
00:03:32>> For right now just leave it at that.
00:03:34>> Okay.
00:03:35I trust you.
00:03:41>> No one has once said anything for me, a voice, that I love my daughter, that I want her safety, and that she and the rest of my family is my only concern.
00:03:56>> I'm writing this down.
00:03:56It's literally going to be a quote.
00:04:02>> All I want is to see her again.
00:04:07To hear her laugh, to see her smile, and to just be with our family.
00:04:16Nothing else matters to me at this point.
00:04:21>> Understand that we all feel that way.
00:04:23Every one of us.
00:04:24Okay?
00:04:25>> I know.
00:04:27But again, they've been hearing that from you, from her uncle, from her grandparents, not from -- I've been praying every single day for insight and everybody's thoughts and everybody's feelings.
00:04:48So I know where you stand and where you're coming from.
00:04:49And I know where you're sitting right now.
00:04:51And mom and lee and joe schmo walking down the block that's seeing this every day on the media for the last month.
00:04:55I can understand everybody else's side in this.
00:04:57But the worst part is that nobody can see my side.
00:05:00And I have to keep my mouth shut.
00:05:01I have to keep my mouth shut about how I feel and with everything else because all i need to do is give the media more stuff, for the detectives and whoever else to throw back in my face when this goes to trial.
00:05:09>> I love you.
00:05:10>> I know.
00:05:20>> I want you both home so bad, casey.
00:05:23I'm trying to stay so strong for you.
00:05:25>> And you're doing such a great job, mom.
00:05:28I want you to know that.
00:05:29You have.
00:05:29Everybody has said that.
00:05:30Everybody tells me every day.
00:05:33>> I'm trying to hard, but it's getting harder every day.
00:05:36>> You have to stay as strong as you can, mom.
00:05:37You have to.
00:05:37I know it's hard.
00:05:38Trust me.
00:05:40I know -- I know better than anyone right now.
00:05:42>> I know you do.
00:05:47>> We're going to get our little girl back.
00:05:50She's going to be just as she was.
00:05:51>> I'll never let anybody outside the family -- >> I know.
00:05:54Trust me, I've said the same then.
00:05:56I'm going to be the crazy overprotective mom at that point, but I don't care.
00:06:00I think it's well warranted, well deserved.
00:06:04>> You've always been protective mommy.
00:06:05>> Yeah, well, like I said, the crazy.
00:06:08I won't let her out of my sight.
00:06:11We'll figure everything out, but I want it to overlap where we can all have our time.
00:06:17And I'll be with her.
00:06:19She's not just my little girl.
00:06:24And I know -- I mean, she's my baby.
00:06:25She'll always be my baby.
00:06:26But she will always be your baby and dad's baby and lee's baby.
00:06:31She's our little girl.
00:06:35We miss her.
00:06:36We love her.
00:06:37I miss her, I love her dearly.
00:06:39And I want nothing more than for her to come home and to be safe.
00:06:43And to be where she belongs with her family.
00:06:49It's obvious that we'll stop at nothing to get her back.
00:06:55Because I know in my heart, i know in my gut, I know with every ounce of my being that we will be with her again.
00:07:04>> Dad, I don't care about all this other stuff.
00:07:06I mean, I don't care about the media.
00:07:07I don't care about what people have been saying about me.
00:07:10That doesn't matter.
00:07:11Because I know it's not true and everyone that knows me knows it isn't true.
00:07:15All I want is caylee home.
00:07:17But I want to be there when she comes home.
00:07:21>> How did you get through last saturday?
00:07:22>> I didn't.
00:07:26I spent the day almost completely by myself.
00:07:34With my head under the covers.
00:07:36I read my bible almost the entire day.
00:07:42It was miserable.
00:07:42It was completely and utterly miserable.
00:07:44Just like I have been the entire time, that was the first time outside of our visits that I've really shown any emotion.
00:07:49And I was open, and I didn't care just because I couldn't hold anything back.
00:07:53I broke down.
00:07:56It was the first time that i truly, truly broke down.
00:07:59It hurt, and I'm still recovering from that.
00:08:05Hearing about the fact that mom was making chili and there was probably a bunch of people at the house.
00:08:11You have to keep your strength as much as you can.
00:08:17>> I know.
00:08:17Because she's going to need us when she comes home and then you're going to need us when you get home.
00:08:20>> I'll be fine.
00:08:23I'm fine now because I have you guys.
00:08:24I have you guys even if it's not in physical form at the moment.
00:08:27I have your love and support.
00:08:29I have everything that I -- >> she doesn't see us.
00:08:32She doesn't see us.
00:08:35>> She's going to need all of us.
00:08:36So we all need to be strong.
00:08:37You need to take care of yourself.
00:08:38I was just telling dad, like i told lee, you need to eat.
00:08:41You need to sleep.
00:08:45>> This person is not going to hurt caylee is she, casey?
00:08:50She's not going to hurt caylee, is she, honey?
00:08:51>> No.
00:08:52I told you in my gut I know she's still okay.
00:08:56I can feel it, mom.
00:08:57I know she's still okay.
00:09:01>>> When we come back, tot mom comes face to face with detectives.
00:09:04All caught on video.
00:12:20>>> Tonight, there's a battle brewing.
00:12:21To determine if tot mom will get the death penalty.
00:12:27Will tot mom's own words be used against her?
00:12:29We've obtained hours of footage of tot mom, casey anthony, spewing story after story.
00:12:33Take a look.
00:12:35Cops arrest anthony and immediately begin questioning her.
00:12:38It's all on tape.
00:12:43>> Is your daughter in a better place?
00:12:44>> No, she's not.
00:12:45>> Are you worried about her?
00:12:46>> I'm absolutely petrified.
00:12:47If she was with her family right now, she'd be in the best place.
00:12:49She's not.
00:13:00She's with someone that i absolutely do not trust.
00:13:01And that I'm absolutely scared that -- >> that you don't trust yet was baby-sitting your daughter for a year?
00:13:06>> I don't trust her now.
00:13:07Because of what happened.
00:13:08>> What point did you stop trusting her?
00:13:14>> The moment that her phone was cut off and I couldn't get in contact with my daughter.
00:13:17>> So you thought then, man, something ain't right?
00:13:18>> Something's wrong.
00:13:20>> And when you started thinking that something was wrong, which police agency did you call first, us or the city police, or who did you call first?
00:13:26Who did you go to for help first to help try to find her?
00:13:29>> No one.
00:13:30>> No one.
00:13:30Okay.
00:13:31All right.
00:13:31Okay.
00:13:34Well, I'm glad we got that straightened out.
00:13:40>> You purposely misled us.
00:13:40This was all an attempt to help find your daughter, right?
00:13:43>> No.
00:13:44>> That makes sense to you, correct?
00:13:46>> Again, in a backwards sort of way, yes.
00:13:47>> In a backwards sort of way.
00:13:48>> I'm coming back to places that are familiar to me, that i know are familiar to her.
00:13:53>> Does that make sense to you?
00:13:55It makes sense to you that I'm trying to help the police find my daughter by giving them a bunch of bad addresses?
00:14:03That makes sense to you?
00:14:03>> That's what I said, yes.
00:14:04>> No, no, I'm asking you, that makes sense to you?
00:14:06My attempt -- >> that part of it, no.
00:14:08>> My attempt to help him find my child, okay?
00:14:11What I've done to try to help him find my child is I've given him a whole bunch of addresses to go to that are bad addresses.
00:14:17That's what I did to help him try to find my child.
00:14:19That makes sense to you?
00:14:21>> Everything you've told us is a lie.
00:14:22You're looking me in the eyes.
00:14:23You're looking at -- everything you've told us is a lie.
00:14:25Every single thing.
00:14:26And you -- >> no, it isn't.
00:14:28>> Yes.
00:14:28And you can't keep sitting here and telling us the same thing and getting constantly over and over and over again we're disproving everything that you're telling us.
00:14:36You're tellithat you've lied to us.
00:14:37You're telling us you're giving us misinformation.
00:14:38Everything you're telling us.
00:14:39Okay?
00:14:42This needs to end.
00:14:42>> The truthful thing -- >> this needs to end.
00:14:44>> -- Is I have not seen my daughter.
00:14:46The last time that I saw her was on the 9th of june.
00:14:50>> And what happened to caylee?
00:14:51>> I don't know.
00:14:51>> Sure, you do.
00:14:52You need -- >> I don't know.
00:14:54>> Listen.
00:14:55Something happened to caylee.
00:14:57We're not going to discuss the last time you saw her.
00:14:58I'm guessing something bad happened to her some time ago and you haven't seen her.
00:15:01So that part is true if you say you haven't seen her because she's somewhere else right now.
00:15:08>> She's with someone else.
00:15:09>> So you're more afraid of your mom's reaction than you are if you ever see your daughter again?
00:15:12>> No, I'm absolutely petrified.
00:15:16Absolutely petrified.
00:15:17I know my mom will never forgive me.
00:15:18I'm never going to forgive myself.
00:15:20Because there's that chance that I might not see caylee again, and I don't want to think about that.
00:15:25>> Do you think the result will be different?
00:15:27>> Absolutely.
00:15:29A lot of different aspects.
00:15:31That's the conversation I've had not only with my attorney but with my family.
00:15:39I mean, we all still feel, I as a mom, I know in my gut there's -- the feeling as a parent, you know certain things about your child.
00:15:48You can feel that connection.
00:15:49And I still have that feeling, that presence.
00:15:52I know that she's alive.
00:15:56Whether you have a bucketload of evidence downstairs that contradicts that and says otherwise or all you have is speculation.
00:16:05Or nothing at all.
00:16:09I mean, whatever it is, if there's still that chance, with all these tips that have come through, I know it's been speculated how many thousands of tips have come through.
00:16:14>> There's been a lot.
00:16:16>> There have been a lot.
00:16:20I have an open mind when it comes to things.
00:16:23I try to keep an open mind when it comes to things, but if I'm innocent, that's as far as that goes.
00:16:31And as far as anything else on top of that, I'll take this as far as I need to to prove my innocence.
00:16:37Which I guess is my point in all of this.
00:16:39>> When you say you'll take it as far as you need to to prove your innocence -- >> with -- >> -- what do you mean?
00:16:44>> Serving the indictment today and the warrant for my arrest and everything else.
00:16:48I'm not running.
00:16:52>> They're finally trying to be nice to us again.
00:16:53So -- >> good.
00:16:54They need to be nice to you.
00:16:55Because if they're not, don't talk to them.
00:16:57>> Yeah.
00:16:58>> Serious.
00:17:02>> Yeah.
00:17:03>> I mean, I want their help as much as we can get it, but they need to help us, too.
00:17:07>> I know.
00:17:08>> It needs to go both ways.
00:17:09It can't be one-sided.
00:17:10>> I know.
00:17:11I know.
00:17:13>> I'll try to help them in whatever way that I can.
00:17:16But if they come in here attacking me, they're not getting [ bleep ].
00:17:21Sorry.
00:17:23>>> The to the tot mom investigation started with a series of frantic 911 calls.
00:17:28We have the 911 calls.
00:17:29As tot mom in her own words, next.
00:21:33>>> One month.
00:21:37That's how long it took for tot mom to even admit her daughter, caylee, was missing.
00:21:40Listen as tot mom tells a 911 operator she knows who has caylee.
00:21:44Even claiming she spoke with caylee briefly.
00:21:47Will those words come back to haunt tot mom at trial?
00:21:51>> Is your daughter there?
00:21:53>> I'm on the phone with them.
00:21:54>> Is your daughter there?
00:21:55>> Yes.
00:21:56>> Can I speak with her?
00:21:59Do you mind if I speak with her?
00:22:00Thank you.
00:22:04>> I called them two hours ago.
00:22:06They haven't gotten here.
00:22:07Casey finally admitted that ok her a month ago and she's been trying to find her.
00:22:09>> Ma'am.
00:22:10Ma'am?
00:22:17>> Casey, they want to talk to you.
00:22:18Answer their questions.
00:22:19>> Hello?
00:22:20>> Hello?
00:22:20>> Yes.
00:22:21>> Hi.
00:22:22What can you -- can you tell me what's going on a little bit?
00:22:26>> I'm sorry?
00:22:26>> Can you tell me a little bit what's going on?
00:22:28>> My daughter's been missing for the last 31 days.
00:22:33>> And you know who has her?
00:22:35>> I know who has her.
00:22:36I've tried to contact her.
00:22:38I actually received a phone call today now from a number that is no longer in service.
00:22:43I did get to speak to my daughter for about a moment for about a minute.
00:22:50>> Okay.
00:22:51Did you guys call and report a vehicle stolen?
00:22:52>> Yes.
00:22:53My mom did.
00:22:54>> Okay.
00:22:57So is it a vehicle stolen too?
00:22:58>> No.
00:23:00This was my vehicle.
00:23:02>> What vehicle was stolen?
00:23:04>> It's a '98 pontiac sunfire.
00:23:05>> Okay.
00:23:06I have deputies on the way to you right now for that.
00:23:10But now your 3-year-old daughter is missing.
00:23:12Caylee anthony.
00:23:12>> Yes.
00:23:14>> White female.
00:23:16>> Yes, white female.
00:23:17>> 3 Years old.
00:23:2208/09/2005, Her date of birth?
00:23:23>> Yes.
00:23:26>> We'll have a court order to get her.
00:23:28If that's the way you want to play.
00:23:29We'll do it.
00:23:30And you'll never -- >> that's not the way I want to play.
00:23:33>> Well, then you have -- no, I'm not giving you another day.
00:23:35I've given you a month.
00:23:36>> And you last saw her a month ago?
00:23:39>> 31 Days.
00:23:40It's been 31 days.
00:23:42>> Who has her?
00:23:44Do you have a name?
00:23:46>> Her name is zenaida fernandez-gonzalez.
00:23:50>> Who is that?
00:23:52Baby-sitter?
00:23:54>> She's been my nanny for bay year and a half.
00:23:57Almost two years.
00:24:04>> Why are you calling now?
00:24:05Why didn't you call 31 days ago?
00:24:05>> I've been looking for her and have gone through other resources to try to find her, which was stupid.
00:24:11>> Okay.
00:24:11Can you give me the name of the nanny again?
00:24:13Like spell it out for me.
00:24:16>> Zenaida.
00:24:19Z-e-n-a-i-d-a.
00:24:21>> Last name?
00:24:22>> Fernandez.
00:24:22>> Fernandez?
00:24:27>> Hyphen gonzalez.
00:24:31I think the officers are here.
00:24:39>>> When we cme back, her daughter's missing, but behind bars tot mom seems more worried Your homecoming queen is...
00:27:09Becca Winegar!
00:27:11[Cheering and applause] >>> Right now the battle raging.
00:27:35Will tot mom get the death penalty?
00:27:37Her defense desperately wants to ban hundreds of statements and photos of tot mom partying, some taken in the days and hours after little caylee goes missing.
00:27:50Will tot mom's own words be used against her at trial?
00:27:53Take a listen to this jailhouse video.
00:27:55It's a phone call between tot mom and her family.
00:27:59She's actually complaining her image is being tarnished.
00:28:05It's nothing but me, me, me, me, me.
00:28:12>> I want to bring up this thing about -- about you know, you being the boss.
00:28:15You're the one that can control everything.
00:28:16>> No, I -- dad.
00:28:17Please.
00:28:18>> Sweetie, I'm not trying to get you upset.
00:28:19I'm trying to talk to you.
00:28:20>> No, but I am upset now.
00:28:22>> Please.
00:28:23>> I'm completely upset.
00:28:26One, the media's going to have a eaking field day with this.
00:28:33>> No, they're not.
00:28:34Listen -- >> how am I supposed to take this?
00:28:35Let me speak for a second.
00:28:38Dad, I let everybody talk.
00:28:39>> Okay.
00:28:39>> They're not releasing it -- well, I hope not.
00:28:41I'll keep saying whatever I have to about the police.
00:28:42So they don't want to go.
00:28:43>> Here's mom.
00:28:44>> Can someone let me -- come on!
00:28:45>> Casey.
00:28:46Hold on, sweetheart.
00:28:46Settle down, baby.
00:28:47>> Nobody's letting me speak.
00:28:49You want me to talk and -- >> all right.
00:28:51I'll listen to you.
00:28:52>> Give me three seconds to say something.
00:28:53>> Go, sweetheart.
00:28:55>> You guys have given everything to the police.
00:28:56They're not helping us.
00:28:58It's obvious.
00:29:00We know their intentions.
00:29:01So I'm sorry.
00:29:03I've helped in every way that i possibly can since the day I got here.
00:29:08>> Okay.
00:29:08Well, let me -- >> they didn't even give me 24 hours to help them, the police, without putting me here.
00:29:18So it's obvious where everybody's intentions lie.
00:29:19I know you guys want caylee.
00:29:21I want caylee more than -- than anybody can understand.
00:29:27But I can't do anything.
00:29:28I can't do anything from where I'm at.
00:29:31I want to openly thank not only our family but our friends and the community for, you know, their unconditional love and support.
00:29:44>> Okay.
00:29:45>> I want to thank, obviously, all the charities that are -- that are donating their time and their efforts and their resources to help us.
00:29:59I want everyone to keep caylee and our family in their prayers.
00:30:05And if there's anyone that has any information, please to come forward without haste.
00:30:13>> None of us have anything right now, casey.
00:30:15>> You guys have each other.
00:30:16You're sitting next to dad.
00:30:16You still have lee.
00:30:17You have access to our community, to our family and friends, to our house.
00:30:23You're taking for granted the fact that I have no one to comfort me but myself.
00:30:33And the occasional visit, which has to be business for the sake of finding caylee.
00:30:42So yeah, I may look like I'm in charge.
00:30:48Wrong.
00:30:50I'm completely pushed away from everything.
00:30:51This is seriously the first time that I've been angry, that I've been this frustrated to where I -- I can't even think straight at this moment.
00:31:03Throughout this entire thing.
00:31:04I was pissed off that day at the police station.
00:31:08I was mad when all of that happened.
00:31:09But I tried to look at things objectively.
00:31:11And this entire time I haven't sat in my room for the entire month and been mad.
00:31:13Not once.
00:31:14Not one time.
00:31:15But right now this is the most ajs tated and frustrated that I've been, even when I've sat with jose and I watched that episode of "nancy grace"ndhe stuff that was being said about mom and being said about me and him and everybody else and stuff that I've heard.
00:31:30It's frustrated me, but I've let it go.
00:31:35Right now I'm so hurt by everything, I don't even know what to say.
00:31:39And I hate to say that.
00:31:43>> Well, I'm not trying to upset you, and neither are mom.
00:31:45We're not trying to.
00:31:49And if we are, I'm sorry for that.
00:31:51>> I know that's not your intention.
00:31:53You have to understand where I'm coming from in this.
00:31:56And obviously, none of you are.
00:31:58By still expecting me a month literally out of the loop to have some sort of new insight on stuff?
00:32:03I mean, really?
00:32:05>> Everybody is looking for her.
00:32:07Are we going to be able to find her, do you think?
00:32:10>> I hope we can, mom.
00:32:13Now, I didn't get a chance to ask lee.
00:32:17>> Can you look up a little bit more?
00:32:21Raise your eyes up a little bit.
00:32:22There you go.
00:32:22So -- no.
00:32:24Look straight up so I can look into your eyes, darling.
00:32:25Thank you.
00:32:27You know I need to do that.
00:32:30It's okay to cry, casey.
00:32:31It's all right, love.
00:32:32We've all been crying.
00:32:35I know the pictures with caylee in zanny's apartment.
00:32:41Is zanny's apartment the ones with the drums?
00:32:44>> She had a drum set, yes.
00:32:47>> The one in the picture?
00:32:52>> I think there are even other pictures.
00:32:53I told lee to look through everything.
00:32:55>> Okay.
00:32:55Is that zanny's apartment?
00:32:58Because I know whose apartment it is.
00:33:00Is it zanny's apartment?
00:33:02>> That exact apartment, no, it was ricardo's apartment.
00:33:04It was set up a lot like zanny's apartment.
00:33:08>> Okay.
00:33:11Do we have any pictures of zanny's apartment?
00:33:14>> Mom, lee and I already talked about this.
00:33:16I don't know -- it could be on the disk at home.
00:33:19I don't know.
00:33:23Being as strong as I can considering the situation.
00:33:26It's just hard.
00:33:27It's just very hard.
00:33:30>> I know.
00:33:32I can understand.
00:33:41>> God, I just want to go home.
00:33:43Every day I wake up I'm just hoping and praying that I get to go home.
00:33:46I just want to be with you guys.
00:33:47I just want to help find her.
00:33:51Because I feel a little hopeless.
00:33:53I feel a little helpless here.
00:33:54I mean, honestly.
00:33:55Not really hopeless but more helpless.
00:33:59Because I can't do anything from where I'm at.
00:34:04Oh, god.
00:34:09My heart is aching because i just want to be back with our family.
00:34:21In my gut every day stronger and stronger I know we're going to see caylee.
00:34:23I know she's coming home.
00:34:25>> Our family's broken.
00:34:27We want to have that fixed.
00:34:28We know what that means, to have our family broken apart by something now.
00:34:31By tragedy.
00:34:34We don't want this to any longer be a tragedy.
00:34:40I don't want to be one of those thousands of parents that has to deal with the possibility of never seeing their child again.
00:34:49With the potential of knowing that their child's alive and that they're with someone else.
00:34:56The thought of that every day makes me sick.
00:35:00>>> When we come back, more evidence the defense wants thrown out of court for the jury to never see or hear.
00:35:08This as the battle rages as to whether tot mom will face the florida death penalty.
00:38:41>>> The best witness for the state?
00:38:45Casey anthony, herself, in her own words.
00:38:47Take a listen to anthony in police custody claiming she wants to help find her daughter.
00:38:51But then immedtely clams up and demands her defense lawyer.
00:38:56Why?
00:38:58>> Well, you'd have to excuse me for misunderstanding what we just went through.
00:39:04>> That wasn't us running.
00:39:06That was us trying to counteract the media for following us down to the jail.
00:39:11Because our only intention was to take me down to the jail to surrender me before this happened.
00:39:19That was the only thing we were trying to accomplish.
00:39:21You can ask mr. baez.
00:39:21You can ask my mom.
00:39:23You can ask anyone from the office.
00:39:25Even my bondsman, who was the driver.
00:39:26That was our only intention today.
00:39:30>> Okay.
00:39:33What I'll entertain you on the formalities here.
00:39:39I just want to read the sheet to you and have you sign it.
00:39:40>> Okay.
00:39:41>> And then you've already waived we'll just do that again through the formalities.
00:39:43>> That's fine.
00:39:44>> Because I'd like to be as thorough as I can possibly be.
00:39:46>> I'm fine with that.
00:39:47>> Is that okay with you?
00:39:48>> Yep.
00:39:51>> Orange county sheriff's office waiver and affidavit form.
00:39:54You have the right to remain silent.
00:39:56Anything you say will be used in court as evidence against you.
00:39:58You're entitled to talk to an attorney now or have him present now or anytime during questioning.
00:40:03If you cannot afford an attorney, one will be appointed for you without cost.
00:40:07Do you desire to consult with an attorney first or have one present during this interview, yes or no?
00:40:12>> Yes.
00:40:13>> Okay.
00:40:14Go ahead and mark that.
00:40:15And if anytime -- we're done.
00:40:16>> Yep.
00:40:18>> You just cross the line right through that and give me your signature.
00:40:21Right on that line.
00:40:23>> You don't need me anymore?
00:40:26We're done?
00:40:29>> We're done.
00:40:30And right there.
00:40:30And it is currently 4:22.
00:40:43Now, this is no secret.
00:40:45I have recorded that.
00:40:46>> Yeah.
00:40:47>> Not so it would end up on any television show but because I'm thorough.
00:40:50>> So there's no question.
00:40:51Exactly.
00:40:52>> No question.
00:40:56So I can take my recorder and turn it off.
00:40:57>> Yeah.
00:40:57>> Okay.
00:40:59>> I expected you to record that anyway.
00:41:01>> I've identified myself toou while you're in custody.
00:41:03>> Yes.
00:41:05>> And you have -- you've signed this, you want your attorney present.
00:41:07>> Yes.
00:41:07>> Through that conversation we've agreed -- >> yes.
00:41:13>> Because -- express that to me again so I have full understanding before I get on the phone with him.
00:41:20>> We have discussed before that we have no problem sitting down together, him and i, and speaking with law enforcement or listening to all the questions that you have and discussing it and then we go from there.
00:41:28>> Okay.
00:41:30>> And that's -- there's been no success with that so far?
00:41:32>> Nobody's taken us up on that.
00:41:34>> So we're going to open that window right now.
00:41:37>> Okay.
00:41:39>> And hopefully we can make something happen.
00:41:47Because ultimately, I think we have the same interest.
00:41:51>> Mm-hmm.
00:41:52>> Finding your daughter.
00:41:57>> Do have have interest in helping law enforcement -- from the beginning.
00:42:04Unfortunately, my hands were literally tied.
00:42:05And I was put in a position where someone's trying to trick a confession out of me and -- >> I -- >> -- that's not going to happen.
00:42:09>> Now, don't go there.
00:42:10You know as far as how we have to do things, and I would want to do things aboveboard and straightforward.
00:42:19I would want to read you your rights and mirandize you.
00:42:21 baez, I'm sure, has gone through that thoroughly with you, coached you on what to say, which is fine.
00:42:24That's his right.
00:42:25That's your right.
00:42:30But i, as a law enforcement officer, still am afforded the right to approach you as a suspect -- I'm not going to sugarcoat it.
00:42:39That's one thing you'll never get with me, is a mind game.
00:42:40>> I appreciate that.
00:42:41>> It's been a long day.
00:42:41>> It has been.
00:42:42>> How was my dad this morning?
00:42:43>> He had a hard time.
00:42:43>> Yeah.
00:42:45>> Honestly.
00:42:49>> I got a chance to hear him talking to my mom.
00:42:52I spoke to him last night and this morning for just a quick second before he left.
00:42:54>> Yeah, I talked to him this morning for a little bit.
00:42:55He was with mark.
00:43:00Yeah, he was really struggling.
00:43:03I mean, I can imagine him having a hard time.
00:43:05He was being called in to -- to essentially provide testimony to indict you.
00:43:11>> Mm-hmm.
00:43:12>> And he was really struggling with that.
00:43:13>> Yeah.
00:43:15>> And I felt bad for him, to be honest with you.
00:43:18I truly did.
00:43:20>> I told him last night, I know he was subpoenaed and under the law he had to answer whatever questions were asked and I told him to do what he had to do at that point and if he didn't he'd be held in contempt of court.
00:43:31I didn't want to see that happen.
00:43:32So -- >> what did he say?
00:43:36>> He just hugged me and told me that he loved me and to know he was struggling with it even last night.
00:43:40So -- >> I think it was probably more so this morning.
00:43:42>> Yeah.
00:43:43I could see that with the little bit that I saw from the media, from the pictures and the little bit of footage that they had.
00:43:50>> You guys watched it on tv?
00:43:52>> Well, we watched it online a little bit.
00:43:54>> Really?
00:43:54>> Yeah.
00:43:55I try to stay away from the tv as much as possible.
00:43:57At least with the internet I can scroll through, read what i want, and then just get rid of it that much faster.
00:44:03So -- just a random question.
00:44:06>> Sure.
00:44:07>> Are there cameras in all of the rooms or -- >> I have no freaking clue.
00:44:11I've never been in this part of the building.
00:44:13So my guess would be yes.
00:44:13>> Yeah.
00:44:14That's what I was thinking, too.
00:44:15My mom wasn't aware that there was a camera in the room, i guess, when she met with milledge and I forget who else.
00:44:22And the big interviews that were released to the media.
00:44:27And she was infuriated.
00:44:29>> Uh-huh.
00:44:30>> You would think that's something you should be told, but you don't have to be.
00:44:36>> Right.
00:44:36The law is the law.
00:44:37>> Yeah.
00:44:40>> Here's my question.
00:44:41I know this is a question that a lot of people have asked.
00:44:43The grand jury and all that, it's supposed to be secret.
00:44:44But it was released to the media right off the bat.
00:44:45My dad hadn't even been subpoenaed, and that was released.
00:44:49>> The happenings are secret.
00:44:53>> Uh-huh.
00:44:54>> What takes place within the room is secret.
00:44:56>> Yeah.
00:44:57But as far as when it actually is convened and, you know, pulled together, the witnesses and stuff like that, that's not also supposed to be secret?
00:45:05>> It depends on how they are subpoenaed.
00:45:06>> Okay.
00:45:06>> If you're subpoenaed under a regular court order, that's a public document.
00:45:08>> I'm not sure how that came through.
00:45:12>> But if the subpoena itself is just a regular grand jury subpoena, that's public records.
00:45:16It doesn't say what it's for, it doesn't say what case it's in.
00:45:18It just says you're subpoenaed to appear before the grand jury.
00:45:22>> Well, them announcing that there was going to be a grand jury, and obviously my name was thrown out, they knew who the grand jury was for.
00:45:34>> Who threw your name out?
00:45:35>> The media said that it was from an inside source, meaning in here.
00:45:40So that's where they all say -- >> I can tell you what I think of the media and what I think of people who leak stuff to the media.
00:45:45>> I think it's garbage.
00:45:46Yeah.
00:45:47I agree.
00:45:48>> That doesn't make it any less necessary.
00:45:55Without them -- >> mm-hmm.
00:45:59>> I'll be quite honest.
00:46:00Without the media we don't find a quarter of the kids that we -- >> oh, I agree.
00:46:02It helps.
00:46:04The exposure has helped bring in so many tips for my daughter.
00:46:08>> But at the same time I agree what it creates is it creates a monster that otherwise isn't necessary.
00:46:13>> Exactly.
00:46:15>> If I read you your rights and we take the time to do that and -- you've met, right?
00:46:21Have you two met?
00:46:22>> No.
00:46:23>> Casey, I'm scott.
00:46:23>> Nice to meet you.
00:46:24Okay.
00:46:24>> Okay.
00:46:27Take all that aggravation from prior contacts out of your mind.
00:46:30It's a different game.
00:46:32>> Mm-hmm.
00:46:33>> I'micide corporal.
00:46:35Fbi.
00:46:37Not john allen.
00:46:38Not yuri.
00:46:39Not the aggravation that the family -- that they see those two as.
00:46:43And I'm not minimizing their professionalism or anything they've done.
00:46:46>> Mm-hmm.
00:46:49>> Okay?
00:46:49I just want to approach it in a different manner.
00:46:52And today with what was done today at the grand jury, regardless of accusations from everybody around, there's been people that have reviewed what it so far.
00:47:04Casey, we're at the end of the hallway.
00:47:06>> To an extent, yes, i understand that.
00:47:07>> We're -- we need you to determine what our next course of action's going to be.
00:47:15>> Okay.
00:47:16>> Really.
00:47:17Not saying you're in control of the situation.
00:47:18You're in control of your situation.
00:47:19That being said, I'd like to read you your rights and talk to you.
00:47:22Is that something you're interested in?
00:47:24>> I would like to do that on the basis of my attorney.
00:47:28If that's possible.
00:47:29>> You'd want him there?
00:47:30>> Yes.
00:47:32>>> When we come back, casey anthony caught on video.
00:47:35Will her own words be fired right back at her in court?
00:51:02>>> Here's what's coming up on "showbiz tonight" a the the top of the news hour.
00:51:15Explosive and tell about jessica simpson.
00:51:20News today about john mayer.
00:51:22That's your "showbiz tonight" news break.
00:51:30Your show at the top of the hour here on hln.
00:51:31>>> Despite thousands of pages of evidence, never stopses insisting that she's innocent.
00:51:42>> You'll be fine once caylee is found.
00:51:50>> I've been here a month and i have nothing.
00:51:53Out of contact with everybody, you guys on the rare occasion that I get to see you.
00:51:58And my attorney, she won't understand.
00:52:01What am I supposed to learn from that.
00:52:04What am I supposed to learn from that?
00:52:07The first week and a half.
