00:00:00Or any of the uc campuses you need to pay very close attention to this story because a judge just ruled you're owed big.
00:00:12They have been loud and as cbs5 cameras documented downright unpleasant but the battle cry of the university of california students hats been the same for the five years that the regents agreed not to raise fees only to do it once the students signed on the dotted line.
00:00:31But some students have done more take their fee fights off the streets taking them to court.
00:00:39A judge ruled in favor of the students.
00:00:44>> Reporter: Representing 2900 students that attended business school, law school, nursing, theater film and television, vetrinary medicine schools and others at uc campuses.
00:00:57>> Every students in this class accepted admission prior to august 2003.
00:01:02>> Reporter: Near 3000 students argued they decided to attend uc because tuition was capped even pointing out the uc website says the fee will remain the same for each student for the duration of their enrolment in the professional degree program.
00:01:20>> We never said this to the 2003/ '04 students.
00:01:23>> Reporter: If you enter professional school in 2002 they said it was capped.
00:01:30>> The judge didn't buy it.
00:01:32>> It is a bait and switch.
00:01:36>> Reporter: Some paid more than what was advertised as capped.
00:01:41A san francisco judge just ruled they may reimburse $38 million on top of $48 million another group of students were just awarded for similar fee hikes.
00:01:51So on the legal score card it is students 2, university of california.
00:01:58 Attorneys for the regents tell me there is a strong possibility of appeal but the real question is how much money will you get if you attended one of these professional schools?
00:02:07>> Well, because this is such a new decision the judge has yet to dole out the exact amount of money.
00:02:11I can tell you this it is all about the amount of time you spent here.
00:02:15So if you had a four-year program you will likely get three years of reimbursement.
00:02:19If it is a two-year program.

00:02:25>> With tuitions and fees going up literally every quarter at uc, this money is what students can use for sure >>> possibly the worst kept secret in politics.

00:03:47[ Applause ] >> Reporter: Mitt romney introduced the woman he once hired.
00:03:52>> I am committing to overhauling our tax system to encourage employers to start hiring californians again and my goal is to help create 2 million new private sector jobs by the end of my first term.
00:04:06Whitman's campaign has been long on promises, jobs, education, balanced budget, reduced taxes but some claim short on specifics.
00:04:15While spending millions on ads she has refused to take reporter question like this one from cbs5's hank plante.

00:04:30>> Reporter: Security crews blocked cameras and put up a shade to block access to whitman.
00:04:35Criticism for some in her own party over the incident may be why she tried a new tact with reporters.
00:04:42She spent a few hours talking to them.
00:04:43But they tried to turn her prior reluctance to talk to her advantage.
00:04:47>> Won't be any screens if you ask me any tough questions.
00:04:50So I'm hear to answer anything you would like to talk about.
00:04:53>> Reporter: Spending an hour fielding questions and has very specific views on how to fix california.
00:04:59>> Meg whitman is not in favor of a lot of the bold changes I'm proposing.
00:05:04Jerry brown isn't either.
00:05:05Voters will have a choice.
00:05:08>> Reporter: Whitman's plan she says is to take on the public employee's union and reduce state workers by 40,000.
00:05:14She said it is a too generous pension system and deregulate california.
00:05:23>> Regulations cost california billions of dollars every year.
00:05:27And have taken almost 4 million jobs out of our economy.
00:05:31As governor the first thing i want to do is institute a moratorium on all new regulations.
00:05:38>> After whitman spoke reporters and photographers were allowed up on the podium to speak with her directly.
00:05:43She did take questions.
00:05:44We managed to get one in about how if she were elected governor she would get all those representatives and senators in sacramento to go along with what she wants.
00:05:53>> It is about leadership.
00:05:55It is about leadership.
00:05:55It is about creating a vision for a better california.
00:05:59And about focusing on doing a small number of things, having the right people working for you.
00:06:06And using that veto pen to make sure that we don't get a whole bunch of bills that have a whole bunch of spending attached to them.

00:06:27President obama today postponed a trip to asia to help usher the bills passage.
00:06:31Here is the plan.
00:06:32First the house will vote on the senate bill approved last year.
00:06:35Then the house and the senate will vote on a companion bill needing just a simple majority in the senate.
00:06:42The democrats seem confident that they can do it without republican support.
00:06:47>> The majority of plans to try and use the reconciliation process to ram through a health care bill.
00:06:56No matter how many times the press and public may be misled by that assertion we are not ramming through anything I tell my friend.
00:07:05>> The vote is going to be close for sure but if all goes according to their plan the president will sign an everyhaul bill from two weeks today.
00:07:18>>> The attorney general office is investigating an illegal prescription drug ring that is linked to corey haim.
00:07:29The attorney general's office say investigators saw a prescription under the actor's name while looking into fraudulent rx pads sold in san diego.
00:07:39Authorities found four prescription drug bottles belonging to haim in the apartment where he collapsed but no illegal drugs were discovered.
00:07:47>>> San francisco prosecutors dropped another 30 cases today.
00:07:51Drug cases.
00:07:51And 35 others are set to go to trial and they were on hold.
00:07:56125 Cases have been halted since tuesday when the police chief suspended drug testing to conduct an investigation of the crime lab.
00:08:04A former lab supervisor is suspected of stealing small amounts of cocaine evidence.
00:08:12Debra mathen has not yet been charged.
00:08:14>>> Everyone wants to live in a safe neighborhood for sure but some people in san ramone do not want a police station.

00:08:32>> Reporter: What he wants to put in this vacant office spues neighbors say is a bad example of planning.

00:08:40>> Reporter: A use totally incompatible with their neighborhood.
00:08:43But what neighbors are fighting against isn't a junk yard moving in, it is the police department.
00:08:48>> The downside to having the police department so close is, number 1, property values.
00:08:54Number 2, there is going to be s.w.a.t.
00:08:57Teams there.
00:08:58The canine unit will be there.
00:08:59All the police cars stored in the parking lot with a fence put around them.
00:09:04>> Reporter: Susan and andrew are leading the effort against the plan to relocate san ramona headquarters right across the street from holmes.
00:09:14>> We are very much for the police department.
00:09:16We have a great police department here.
00:09:17We are big fans of them.
00:09:19We just don't think it makes sense to put a police department right in the middle of a residential district.
00:09:24>> We are bulging at the seams.
00:09:26>> Reporter: The police department has more than outgrown its current office space.
00:09:30The plans to build a new city hall and pd building are on hold due to the economy.
00:09:34So the city council gave preliminary approval to buy this complex on crow canyon road at a bargain price and move the police department in as a temporary home.
00:09:43>> For one we are responsible.
00:09:46I think this is a golden opportunity to get it before it turns bad.
00:09:51>> Reporter: David hudson voted for the idea and wants the city council to eventually redevelop the property into something more compatible in the future.
00:09:58But space is needed now.
00:10:00The police just say they are surprised by such strong neighborhood opposition.
00:10:04>> They may have drawn conclusions off of large cities that may have jails.
00:10:09They may have drawn conclusions off of what they see on t.v.
00:10:12There's a lot of things that could draw that and kind of amplify fears that really are unfounded in a neighborhood like san ramone.
00:10:25>>> School assignment letters are in the mail for students in the unified school district.
00:10:3260% Of students got their first choice this time around they say and nearly 80% got one of their top seven picks.
00:10:37This will be the last school year that kindergarten students will be assigned using the diversity index lottery system.
00:10:44The new system will give priority to kids who live close to campuses and those in neighborhoods with the lowest test scores.
00:10:52>>> Two san francisco high schools are no longer on the list of the state's worst schools.
00:10:59Of the 188 schools originals on that list 37 were dropped and 37 added.
00:11:04Mostly in southern california.
00:11:05The change came after a vote yesterday allowing a technical change to how the schools were selected.
00:11:13Among those dropped burton and marshall in san francisco and in vallejo, franklin and middle schools.
00:11:21The changes highlight complications with the new ranking system that identifies the state's 5% of worst performing schools.
00:11:27Those on the list will have to reform to qualify for millions of dollars in federal grants.

00:13:20>>> Some confused and angry homeowners demanded answers from pg&e representatives today attending what was build as a community workshop on energy conservation on walnut creek but homeowners were there to discuss smart meters specific allegations that their bills went up after they installed them.

00:13:46Last year my usage for the same billing period was 101.
00:13:55It makes no sense.
00:13:56>> After the meeting pg&e representatives viewed her account and told her there wasn't, in fact, an error.
00:14:02They said that the meter reader had incorrectly read the meter.
00:14:07>>> A vaccine for measles and mumps does not cause autism.
00:14:20It says mercury did not cause autism in three cases.
00:14:24It supports the broad consensus.
00:14:27More than 5000 parents filed claims seeking damages believing vaccinations caused their children to develop autism.
00:14:33>>> With an increasing number of infant deaths leading to baby slings some new safety standards are being created.
00:14:41Allen martin and who actually warned about over the shoulder carriers for years.
00:14:46>> Reporter: The consumer product safety commission says it investigated at least 14 deaths in the past 14 years associated with sling carriers.
00:14:56One to two minutes is how long it would take for a baby to die in a sling carrier.
00:15:01>> Reporter: The warning comes too late for lisa cochrane who was carrying her baby in a sling on the trip to the store.
00:15:09>> My baby is not breathing.
00:15:11>> Where are you?
00:15:12>> I'm in costco parking lot.
00:15:16>> He was no longer a normal color.
00:15:21>> Reporter: Infants younger than four months are at greater risk because their neck muscles aren't developed.
00:15:27In a sling they can curl into a c shape with the chin falling into the chest restricting a baby's airway.
00:15:34In her first couple of months lisa has often carried her daughter in an over the shoulder sling.
00:15:40>> I used it walking around the house too but when I had her she rolled into it and it would be facing her and I was constantly looking at her and tilting her over more.
00:15:50>> Reporter: She stopped using it because of the concern she couldn't breathe.
00:15:53And she isn't surprised to hear there is a warning.
00:15:56Consumer reports has been warning about the dangers of baby slings for years.
00:16:02But slings are a popular item at city kids.
00:16:05The owner says they have been used for years all over the world.
00:16:09>> Your body temperature can keep your baby warm on cold days like today.
00:16:13It also frees up your hands to do other things rather than dangerously trying to do something with your child.
00:16:24>> Next week a panel of government agencies and consumer groups will discuss some new safety standards for those baby slings.

00:16:48I'm about ready to share some of the rainfall totals today but I found them very misleading because they were taken from 4:00 a.m.

00:16:56This evening and if you were out and about like these guys were for the evening commute you know we had a lot of rain after 4:00 p.m.
00:17:02So let's take a look at some of those totals.
00:17:09SANTA ROSA WITH 6/10ths.

00:17:15About half inch in san francisco.
00:17:18And that is very misleading because all of our rain gauges do suggest that san jose picked up over half an inch of rain.

00:17:38The water temperatures at 52 degrees.
00:17:40This is a cold front that generated the high swells for your saturday now due east of the bay area as it also sags to the south and will leave the northern half of the state with 58 degrees at the state capital.
