00:00:25My first guess is tyanna.
00:00:28You called the show, why?
00:00:29>> Yes.
00:00:30I called the show because back in 1993, I was convicted of molesting my daughter.
00:00:37She was 3 at the time and ended up spending five years in prison.
00:00:42As a result, I ended up getting my conviction overturned.
00:00:46>> Steve: Wait a second.
00:00:47You were convicted of molesting your daughter.
00:00:52>> Yes.
00:00:53>> Steve: You did five years in jail?
00:00:55>> Yes.
00:00:55>> Steve: Did you molest your daughter?
00:00:58>> No.
00:00:58As a result.
00:00:59What had happened, a family member who was caring for my daughter at the time had custody of her, she did not want me t be in my daughter's life.
00:01:08That's how -- >> Steve: Why didn't she want you in your daughter's life?
00:01:13>> For one she couldn't have no kids of her own.
00:01:16It was more or less like she wanted her all for herself.
00:01:19And if I really wasn't going to be in her life, so to speak, she felt like I didn't need to be in her life, go ahead and take care of yourself.
00:01:30>> Steve: How did you end up being convicted and going to jail for five years?
00:01:35>> I was going through a custody hearing.
00:01:38I walked through the courtroom, my aunt and several other people that were there in the courtroom, were standing around, and my attorney, she went over to my aunt, and the other women that were standing over there along the side during the custody hearing, and asked them, who are you.
00:01:57They gave their names.
00:01:59It was a detective.
00:02:03From child protective services, and it was a social service worker.
00:02:08She told my lawyer, we have allegations to say that you sexually molested your own daughter.
00:02:14Now, how that allegation came about was, on a weekend visit, i had my daughter for the weekend.
00:02:24It was a girl, I was to loose my daughter, me, another family member at the home with us.
00:02:30Which was my [ bleep ].
00:02:31During bath time, yolanda complained her coo coo was hurting.
00:02:44I said what's wrong with it, she said I don't know.
00:02:48I said you don't know she said no, I don't know.
00:02:50I looked at her, examed her, thinking maybe I will see something physically with the eye, to why she's complaining.
00:02:59So she never did -- nothing was there.
00:03:01When I took her home that sunday, my aunt ended up, two days later, taking yolanda to the hospital.
00:03:11As a result, of her taking her to the hospital, is when the sexual abuse allegations came up.
00:03:21Okay.
00:03:21Like I said, now back to the court hearing, I didn't find out about it until I actually went to my custody hearing that the allegations of sexual abuse was there.
00:03:32In my presence, so distraught, didn't understand what was going on, I'm trying to figure out what now.
00:03:41You find out the allegations, so you -- assuming you were arrested, right?
00:03:49>> Yes, yes.
00:03:50>> Steve: You had, what, a jury trial?
00:03:52>> No, I ended up getting home incarceration.
00:03:55They put me on home incarceration until they figured out when they wanted to start the trial.
00:04:00I waved my rights by jury, and had -- >> Steve: The judge?
00:04:05>> Yes.
00:04:05>> Steve: And he found you guilty?
00:04:07>> Yes.
00:04:08>> Steve: He found me guilty on the testimony of the 3-year-old and testimony of my aunt saying that I sexually abused her.
00:04:16>> Steve: And this judge sentenced you to five years -- >> no, he sentenced me to 10 to 25 years.
00:04:22>> Steve: After five years you were able to get out of prison?
00:04:26>> Luckily, by the grace of god, the university of akron, law professor.
00:04:32And seven of his students won my case for me.
00:04:35>> Steve: And it was overturned?
00:04:37>> Yes, my conviction was overturned after five years.
00:04:42>> Steve: Okay.
00:04:48[ Applause ] >> Steve: And this isn't part of the story, but I just want to ask you about it, because I'm always curious about it, being in prison, that experience for you was -- >> it was hell.
00:04:59Why?
00:04:59Because for one, being there, accused of molesting your child, people are very harsh when it comes to molesting children, i because that's a horrible thing to do for a child, especially your own child.
00:05:20For them to accuse me and have to save my life, being in prison, just to prove my innocence, has hurt me tremendously throughout my life as a result of this, as I said, I called your show, because you had that on there.

00:05:57You got a lot of nerve coming in here and trying to make these people feel you're the victim when the only victim was yolanda.
00:06:07>> Steve: Do you think your daughter was abused by somebody.

00:06:23>> Yes, I did.

00:06:26>> I contacted him the day it was born.
00:06:29>> She told me the baby was dead.
00:06:31>> Have you ever seen the baby?
00:06:33>> No.
00:06:34Why haven't you seen the baby?
00:06:35>> Because the baby was kidnapped.
00:06:39>> Steve: Did you see a picture?
00:06:42>> I didn't have a picture.

00:10:16>> And how is your relationship with your daughter now in.
00:10:22>> We don't have a relationship.
00:10:30I tried.
00:10:31Every time I tried, I keep getting the door shut in my face.
00:10:46In 1985 marsha gave her rights.
00:10:50At that time she was 16 years old.
00:10:52She asked me to take her in and I accepted her in my life.
00:10:56>> Steve: She went to court an testified against you.
00:10:58And now the child is 16 years old.
00:11:00She's turning over the child to somebody that she went to court and testified was a child molester.
00:11:07>> Yes.
00:11:08>> Steve: It doesn't make sense to me.
00:11:09Why would you then turn her over to the person you accused of molesting this child?

00:11:21>> Steve: You say your daughter testified against you at the trial.
00:11:24But she was 3 years old.
00:11:26>> Right.
00:11:26>> Steve: What was your -- your conviction was overturned and thrown out.
00:11:30What was it thrown out on, what grounds?
00:11:33>> No evidence, but my aunt's testimony.
00:11:37And a 3-year-old child's testimony.
00:11:40>> Steve: You're probably the most passionate person I've ever had on my show, and I can really feel, you've been really hurt by this.

00:11:55Can justice be served?
00:11:57If I'm out here with you all, even you, steve, if I'm out here with you, and I have been sentenced to 10 to 25 years and the ohio supreme court overturned my conviction, who molested my child.
00:12:12>> Steve: And you do have any idea.
00:12:14Do you have a thought who might have done this to your daughter?
00:12:17>> Yes.
00:12:18>> Steve: And who would that be?
00:12:19>> A family member.
00:12:22>> Steve: And her name is -- >> it's a guy.
00:12:24>> Steve: Okay.
00:12:25Marsha is who?
00:12:26>> Marsha married into my family.
00:12:29She's really -- >> Steve: She was the one that testified against you.
00:12:32>> Yes.
00:12:33>> Steve: Against you in court.
00:12:35>> Yes.
00:12:36>> Steve: Did you feel?
00:12:38You said earlier because you believe she couldn't have children?
00:12:42>> Uh-huh.
00:12:43>> Steve: She wanted you out of the picture?
00:12:44>> Yes, yes.

00:12:51For 19 years, I have taken over your job of taking care of your child that you brought to my house and asked me to take care of.
00:12:59I used to have to take her to you in order for you to visit her.
00:13:04You got out of prison and thanked me for taking care of your child and telling you I was a good mother to your child and now you're going to stand here and accuse me of a bunch of bull and lie on me?
00:13:18>> Steve: You went to prison.
00:13:19That's something I did not do.
00:13:21You know it, you know it woman.
00:13:24>> I under you did it.
00:13:29>> Hey you do, you went on the witness stand and said I did it.
00:13:31>> If you didn't do it, why didn't you fight for yourself.
00:13:35Your family was in the courtroom.
00:13:36>> I didn't have the money to fight.
00:13:39>> When a child comes to me and said they been touched she's freaking out because she doesn't want to take a bath -- >> she's touched -- you seen the doctor's report.
00:13:49>> No, it wasn't in the doctor's report.
00:13:52That man never even changed her diaper.
00:13:54>> She was acting out by rubbing on his chest or genital areas -- >> no, no.
00:14:02>> Steve: Doesn't use people's names that aren't here.
00:14:05>> Bottom line is, you wait 16 years to bring this crap up, but why don't you leave it alone?
00:14:15She has gone on with her life.
00:14:20>> I bet she have, but you're following in behind.

00:14:29At some point you became the custodian for this young woman, right?

00:14:34>> Steve: She was 3 years old.
00:14:36Do you believe that someone molested her.
00:14:38>> I believe that someone molested her.
00:14:41I had never believed it was tyanna.
00:14:44>> Steve: Did you testify in court that she did is it?
00:14:49>> I testified that yolanda said tyanna did it.
00:14:54>> I have the doctor's report.
00:14:57>> This girl had she really, truly wanted her child.
00:15:00She had three years to get her long before that even happened.
00:15:04She would go for months and not see this child.
00:15:07>> Steve: Sounds like, according to her, correct me if I am wrong, that she was going through the hearings to get custody of her child.
00:15:14That she was showing up.
00:15:16>> She was fighting for her child but it's not my fought at the time this happened.
00:15:22>> Steve: Nobody is -- is there anybody blaming you?
00:15:25>> I'm tired of being the victim for something, being blamed for something that I didn't do other than love her child and raise her.
00:15:34I came hered to to find out that she said that I possibly molested yolanda or I know who did it, that's the first time i heard that and I'm sitting here saying you got to be out of your mind.
00:15:48>> Steve: So I'm clear, you took a lie detector test before the show?
00:15:52>> Yes.
00:15:53>> Steve: You also took a lie detector test before the show?
00:15:56>> Yes.

00:16:07>> No.
00:16:08>> Steve: She's a grown woman.
00:16:09She's out on her own.
00:16:10You basically raised her?
00:16:13>> Yes.
00:16:15>> Steve: Does she have a desire to be with her mother?
00:16:18>> She says no.
00:16:21>> Steve: She's never been there for yolanda.

00:16:26Because you call took her away from me.
00:16:29You sent me too prison at 21, i was 21 years old.
00:16:32>> Steve: Marsha, what I would like to do.

00:20:43>> Steve: I always wonder myself, can I even remember, vague memories of when I was 3?
00:20:49Even looking back, can i remember things that happened when I was 3 years old?
00:20:53Do you know what happened to you when you were 3?
00:20:56>> I personally don't remember anymore.
00:20:58It was a situation where I have blocked all of this out.
00:21:01Like I've been trying to forget over this all of my life.
00:21:08Every time I get to a point, i can shut that door, I can move on, she brings this back up.
00:21:17>> >> Steve: Your mother?
00:21:18>> Yes.
00:21:19That's the only reason I came here.
00:21:21After today, wasn't to be done with this.
00:21:23To me, if she brings this up again, I feel like don't even call me, don't find a way to contact me at all.
00:21:32You have constantly brought this up in my life.
00:21:34It's like you try to make me miserable.
00:21:37Like you know this is something that has always been an issue for me.
00:21:41And you constantly bring it back up.
00:21:50Instead of letting me move on like I should.
00:21:53In june I graduated from high school.
00:21:55I was a year late, but I did it.
00:22:01Next week -- next week, I start college.
00:22:07This is something you're so busy bringing up the past, you can't be there for my graduation.
00:22:15We've never had a relationship.
00:22:16All because you're stuck on this.
00:22:17If you let this go, we can be happy.
00:22:19You're too busy worrying about this other stuff.
00:22:22>> Steve: You're saying, your mom, if she would stop bringing this up.
00:22:26You would like to have a nice normal relationship with your mother?
00:22:29>> I would love to, but besides that.
00:22:32The other reason we can't have a relationship is because she's mad because I feel like I'm always going to have a relationship with marsha, that's my mother to me.
00:22:40That's the only mother I've ever known.
00:22:46Your nom, tyanna, resenting it?
00:22:52>> Right.
00:22:52To me, yeah, I know she did those five years in jail.
00:22:56I wouldn't wish that on anybody.
00:22:58You're so busy hating a woman who took your job, you're so busy hating a woman who has always told me your another's your mother, regardless.
00:23:09>> Steve: You're saying, marsha always said your mom is your mom.
00:23:13She never talks bad about tyanna?
00:23:16>> No.
00:23:17I wouldn't have made it as far as I am if it hadn't been for her.
00:23:21How can you sit here and honestly say that out of your mouth.
00:23:24This is the only woman I can say when I went to foster care and everything else, she was still right there.
00:23:30No matter what, whatever I did, she's always been right there.
00:23:45>> I mean, this is a very difficult story, because I can honestly see how this has affected you and you want to get past it and move on with your life and go to college.
00:23:58Do you believe your mom is innocent?
00:24:01>> I always believe she was innocent.
00:24:03>> Steve: You don't have any feelings she might have done this to you?
00:24:10>> I personally think she knows who did it.
00:24:14But for a while, I got to the point me wanting to know who it is has always been in the back me moving forward in my life is more important than this >> Steve: Love your attitude.
00:24:25[ Applause ] >> Steve: So, I guess from your point of view, you would like to have a relationship with your mom, but you would like your mom to stop going after marsha, do you think your mom will put any of this behind her, going to jail?
00:24:53>> No.
00:24:54Because even when I set there and had conversations with her when I had first ran away, and i ended up staying with her when they found me, I sat down and i tried to have a conversation with her, and every conversation leads back to this, every conversation, no matter when it is, where it is, everything leads back to this.
00:25:19And you're very emotional, passionate about marsha, your mom made allegations against her?
00:25:27>> Yeah.
00:25:28First time I actually heard about that was this morning, and they kind of took me back a little bit.
00:25:34Because, like I said, this woman is somebody who would give her last breath for me.
00:25:40And I feel as though if she was the one that did that, i wouldn't have the relationship that I have with her.
00:25:46I wouldn't have that bond, because if somebody was messing with you in that manner, it wouldn't have happened once.
00:25:55It would happen time and time again.
00:25:56I was at her house for 16 years.
00:25:59In those 16 years, if it happened one time, and it was her.
00:26:03It would have happened again.
00:26:05>> Steve: She's taken care of you?
00:26:07>> Yes.
00:26:07>> Steve: She's loved you like a mother?
00:26:11>> Yes.
00:26:12>> Steve: Your mother got out of prison two years ago.
00:26:15Why haven't you been able to have a mother-daughter relationship, a normal one?
00:26:20>> It's a situation of where i heard her say earlier she's always tried, but it was never her that was trying.
00:26:28It used to be me finding ways to get in contact with my mother, so I can contact to her and try to figure out a way to make something work with her.
00:26:41Every time I did, it was like i was the one being blamed for her going to jail.
00:26:47I did testify.
00:26:48I can't remember myself that day, but I feel as though I know I wasn't in the p wrong, I did what I felt was right as a child.

00:27:05For you to continuously make a scene like this is my fault, this whole situation is my fault, I feel you are dead wrong.

00:33:28I mean, I see a young woman in pain, I don't think she would be holding anybody's name back if she could say somebody's name.
00:33:37I don't think she's protecting anybody.
00:33:40That's just my gut feeling here.
00:33:42And honestly, whatever time you lost, you're not going to get it back.
00:33:49So I think maybe you do need -- your own daughter, you need to move forward and kind of let this go.
00:33:59Because if you don't let it go, you're going to let her go.
00:34:03>> She's already let me go.
00:34:05>> Steve: You still have a chance, you still have a chance to have a life with your daughter.
00:34:17This is one of the toughest stories I've ever come across.
00:34:21Again, I can't imagine what it's like to be innocent and go to jail and think you're going to be in jail for 10 to 20 years.
00:34:30I know, obviously, you're going to resent mara, because you feel like she stole your baby girl from you, but you have your life ahead of you now.
00:34:40You could still be in jail.
00:34:51What I'm trying to say here, she's the victim.
00:34:55Somebody did something to this little girl, she's the victim.

00:38:39You're missing out on the fact that I'm getting ready to start college.
00:38:43At the rate you're going, you're going to miss out on my whole life.
00:38:46And I feel like if this can't be left alone, I'm better off without her.
00:38:53And for me to say that, that hurts.
00:38:56And she can't leave this alone.

00:39:25None of that, because you being a child at 3, you didn't know no better.
00:39:32But for you to stand there and say, I don't love you, and i don't care for you, and I'm still harboring over the past, yes, I am, but -- >> the only reason you're harboring over the past is because of losing me.

00:40:22These allegations, you go to prison.
00:40:24She's got a point.
00:40:25At some point, you need to know, what's her favorite color, what she likes to eat.
00:40:31There's nothing stopping you.
00:40:32I seriously hear this young lady talking up here and I don't think she's putting on an act, she's saying, I love you mom, i want you in my life, but I don't want to rehash this over and over and over again.
